WHEREAS, the Principal intends for this document to operate as a comprehensive Lasting Power of Attorney for Health and Welfare, superseding any prior medical directives, healthcare proxies, or antecedent instruments to the extent of any conflict;
NOW, THEREFORE, the Principal hereby grants authority, establishes parameters, and sets forth conditions under the following operative terms:
3. EXHAUSTIVE OPERATIVE CLAUSES & LEGAL TERMS
SECTION 1: APPOINTMENT AND SCOPE OF AUTHORITY
1.1 Appointment of Primary Attorney. The Principal hereby appoints [Primary Attorney Full Legal Name] as the Principal’s true and lawful primary attorney-in-fact (herein, the "Attorney") to act in the Principal’s name, place, and stead in all matters concerning the Principal’s personal health, medical treatment, physical care, and general welfare, subject to the limitations contained herein.
1.2 Appointment of Successor Attorney. In the event that the Primary Attorney is unwilling, unable, or legally disqualified to serve, or resigns, dies, or becomes incapacitated, the Principal hereby appoints [Successor Attorney Full Legal Name] as Successor Attorney with identical powers, duties, and fiduciary obligations.
1.3 Scope of Health and Welfare Decision-Making. The Attorney is authorized to make any and all health and welfare decisions for the Principal that the Principal could make if possessing personal capacity. This authority includes, but is not limited to:
- Consenting to, refusing, or withdrawing medical treatments, surgical procedures, diagnostic tests, pharmaceutical regimens, and therapeutic interventions.
- Selecting, retaining, and discharging physicians, nurses, therapists, specialists, institutional care providers, hospitals, nursing homes, assisted living facilities, and hospice programs.
- Accessing, reviewing, and disclosing confidential medical records, clinical notes, psychological evaluations, and protected health information (PHI) protected under applicable privacy statutes (including HIPAA where applicable).
- Determining the Principal’s daily routine, living arrangements, housing, dietary requirements, social activities, travel parameters, and personal care support.
- Authorizing admission to or discharge from any medical, psychological, psychiatric, or residential care facility.
SECTION 2: LIFE-SUSTAINING TREATMENT AND PALLIATIVE CARE
2.1 Life-Sustaining Measures. The Principal directs the Attorney to evaluate the prognosis of treating physicians regarding any terminal illness, persistent vegetative state, or irreversible medical condition.
- Option A (Prolongation): The Principal directs that every available medical measure, artificial nutrition, hydration, and life-prolonging intervention be utilized regardless of prognosis.
- Option B (Withholding/Palliative Focus): If two qualified physicians determine that the Principal has a terminal condition, is in an irreversible coma, or that life-sustaining procedures would serve only to artificially prolong the dying process, the Principal directs that such procedures be withheld or withdrawn, and that treatment be focused on comfort care, pain management, and palliative dignity. (Note: Applicable selection or strike-through must be executed in accordance with local statutory validation requirements).
2.2 Pain Management. The Attorney is explicitly authorized to consent to the administration of pain-relieving medications, narcotics, and palliative therapies designed to alleviate the Principal’s suffering, even if such treatments may indirectly shorten the Principal’s lifespan or induce unconsciousness, provided they are administered in accordance with accepted clinical standards.
SECTION 3: FIDUCIARY DUTIES, STANDARD OF CARE, AND ACCOUNTABILITY
3.1 Fiduciary Standard. The Attorney shall act at all times in strict accordance with fiduciary principles of utmost good faith, loyalty, honesty, and prudence. The Attorney shall prioritize the known wishes, values, and cultural beliefs of the Principal, or, where the Principal’s specific wishes are unknown, act in the demonstrable best interests of the Principal.
3.2 Consultation Mandate. To the extent practicable and clinically feasible, the Attorney shall consult with the Principal regarding any major health, residential, or welfare decision, incorporating the Principal’s expressed preferences into the decision-making matrix.
3.3 Compensation and Reimbursement. The Attorney shall serve without financial compensation for time expended in the execution of these duties. However, the Attorney shall be fully reimbursed from the Principal’s estate or assets for all reasonable, necessary, and documented out-of-pocket expenses incurred directly in the execution of the Attorney’s duties under this instrument.
SECTION 4: TERM, EFFECTIVENESS, AND REVOCATION
4.1 Triggering Event (Mental Incapacity). This instrument and the powers granted herein shall become active and operative exclusively upon the written certification by two (2) independent licensed medical practitioners (at least one of whom is the Principal’s primary attending physician) confirming that the Principal lacks mental capacity to make or communicate informed health and welfare decisions.
4.2 Immediate Effectiveness Option. Alternatively, if initialed here: [Principal Initials], this Lasting Power of Attorney shall become effective immediately upon execution, regardless of the Principal’s subsequent mental capacity, subject to statutory limitations.
4.3 Revocation. The Principal retains the absolute, unrestricted legal right to revoke or amend this Lasting Power of Attorney at any time, provided the Principal possesses mental capacity at the time of revocation. Revocation must be executed in writing, signed by the Principal, and delivered to the Attorney and any relevant medical institutions.
SECTION 5: GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION
5.1 Governing Law. This Lasting Power of Attorney shall be governed, construed, interpreted, and enforced in accordance with the laws of the jurisdiction of [State / Province / Country Jurisdiction], without regard to its conflict of laws principles.
5.2 Dispute Resolution. Any dispute, controversy, or claim arising out of or relating to the interpretation, execution, or performance of this instrument shall be submitted to binding arbitration in accordance with the commercial arbitration rules of the designated regional dispute resolution body, held within [City, State/Country], and judgment upon the award rendered by the arbitrator(s) may be entered in any court having competent jurisdiction.

6.2 Photocopies and Digital Counterparts. A photostatic, scanned, certified, or digital copy of this executed Lasting Power of Attorney shall possess the exact same legal force, effect, and authority as the original document. Third parties, hospitals, and medical practitioners may rely upon a copy of this instrument with absolute immunity.
