3. OPERATIVE CLAUSES & TERMS
Clause 1: Standard Terms (The Act)
1.1 The standard terms set out in the Residential Tenancies and Rooming Accommodation Act 2008 (Qld) apply to this agreement. 1.2 In the event of any direct inconsistency between a special term agreed upon in Clause 14 and the standard terms of the Act, the Act shall prevail to the extent of the inconsistency.
Clause 2: Payment of Rent
2.1 The Tenant agrees to pay the rent in advance on or before the nominated due date specified in Item 2.6. 2.2 The Lessor/Property Manager shall issue a rent receipt in compliance with the Act where rent is paid in cash or by cheque, or upon request by the Tenant for other payment methods.
Clause 3: Rental Bond
3.1 The Tenant shall pay the Rental Bond specified in Item 2.6 to the Lessor or Property Manager upon the execution of this Agreement. 3.2 The Lessor/Property Manager must remit the Bond to the Residential Tenancies Authority (RTA) within the statutory timeframe mandated by the Act (10 days).
Clause 4: Outgoings & Utilities
4.1 The Tenant is responsible for the connection and continuous payment of all utility services consumed at the Premises, including electricity, gas, internet, and pay television, where a separate meter is installed. 4.2 Water Service Charges: The Tenant agrees to pay for water consumption charges levied by the local water authority, provided that: a) The Premises are individually metered; b) The Premises are water efficient in compliance with the Act; and c) The water compliance certificate has been completed and attached to this Agreement.
Clause 5: Maintenance, Repairs & Alterations
5.1 The Tenant must maintain the Premises in a clean, tenantable condition, fair wear and tear excepted. 5.2 The Tenant must notify the Lessor or Property Manager promptly of any damage, defect, or required maintenance. 5.3 The Tenant shall not make any alterations, additions, or affix fixtures to the Premises without obtaining the prior written consent of the Lessor.
Clause 6: Entry by Lessor or Property Manager
6.1 The Lessor, Property Manager, or their authorized agents may only enter the Premises during the tenancy in strict compliance with the notice periods, grounds, and execution protocols outlined in the Act (e.g., routine inspections conducted no more than once every 3 months with valid written notice).
Clause 7: Subletting & Assignment
7.1 The Tenant shall not assign their interest under this Agreement or sublet the whole or any part of the Premises without obtaining the prior written consent of the Lessor, which consent shall not be unreasonably withheld pursuant to the Act.
Clause 8: Breach and Remedy
8.1 If either party commits a material breach of this Agreement, the aggrieved party may issue a Notice to Remedy Breach pursuant to the Act, allowing the statutory remedy period (typically 7 days) to rectify the breach.
Clause 9: Termination
9.1 This Agreement may be terminated by either party in accordance with the provisions of the Act, including the issuance of a Notice to Leave (by Lessor) or Notice of Intention to Leave (by Tenant) with the requisite statutory notice periods.
Clause 10: Entry Condition Report
10.1 The Lessor/Property Manager must provide the Tenant with two copies of the Entry Condition Report (Form 1a) at or before the commencement of the tenancy. 10.2 The Tenant must inspect the Premises, complete, sign, and return one copy of the Entry Condition Report to the Lessor/Property Manager within 3 days of taking possession.
Clause 11: Insurance
11.1 The Lessor maintains building insurance for the Premises. 11.2 The Tenant is strictly advised and required to secure their own contents and personal property insurance. The Lessor accepts no liability for loss or damage to the Tenant's personal property.
Clause 12: Pets
