[Principal Full Legal Name]) with the actual legal names and addresses. - Initialing Selections: The Principal must physically initial each category in Section 3.1 and 3.2. Do not use checkmarks or "X" marks; New Hampshire law prefers initials to verify specific intent.
- The Notary Requirement: The Principal must not sign this document until they are in the physical presence of a Notary Public or Justice of the Peace. Ensure the Notary completes the acknowledgment section and applies their seal.
- Agent Acceptance: While the Principal’s signature must be notarized, the Agent must also sign the "Agent’s Acknowledgment" to signify their acceptance of fiduciary duties.
- Distribution of Originals:
- Principal: Keep one original in a secure location (fireproof safe).
- Agent: Provide a certified copy or duplicate original to the Agent.
- Financial Institutions: Banks and brokerage firms often require a copy of the POA to be on file before they will honor the Agent's requests.
- Recording (Real Estate): If the Agent is intended to sell real estate, this Power of Attorney should be recorded in the Registry of Deeds for the county where the property is located (RSA 477:9).
- Digital Storage: If using DocuSign or Adobe Sign, ensure the platform provides a "Certificate of Completion" that includes the IP address and timestamp of the electronic signatures, though physical notarization is still the "gold standard" for NH real estate transactions.
