THE EMPLOYER: [Name of NHS Trust / Health Board / Employing Authority], an NHS entity organized and existing under the laws of [Jurisdiction, e.g., England and Wales], with its principal administrative offices located at [Employer Address] (hereinafter the "Employer" or "NHS Trust"), and

THE EMPLOYEE: [Employee Full Legal Name], residing at [Employee Address], holding the position of [Job Title/Band] within the [Department/Division] (hereinafter the "Employee").

RECITALS

WHEREAS, the Employer is committed to supporting the health, safety, and rehabilitation of its workforce, consistent with the NHS Terms and Conditions of Service, the Equality Act 2010 (where applicable), and statutory obligations regarding occupational health and employee wellbeing;

WHEREAS, the Employee has been absent from work due to sickness, injury, or medical incapacity for a sustained period and has now been certified as fit to return to work on a restricted, modified, or phased basis, subject to clinical recommendations and operational requirements;

WHEREAS, the Parties intend by this Policy to establish a binding, structured, and transparent framework governing the Employee’s transition back to full-time or standard contractual duties, ensuring operational efficacy, patient safety, and comprehensive legal compliance;

NOW, THEREFORE, in consideration of the mutual covenants, terms, and conditions set forth herein, and intending to be legally bound, the Parties agree as follows:

2. OPERATIONAL DEFINITIONS

For the purposes of this Policy, the following terms shall have the precise legal meanings ascribed below:

  1. "Agreed Phased Return Plan" means the schedule of reduced working hours, altered duties, or modified working arrangements agreed upon in writing by the Employer, the Employee, and informed by Occupational Health recommendations.
  2. "Fit Note" means the Statement of Fitness for Work issued by a registered medical practitioner or authorized healthcare professional pursuant to statutory health regulations, detailing the functional capabilities and restrictions of the Employee.
  3. "Occupational Health Service (OHS)" means the independent clinical advisory service retained or operated by the NHS Trust to evaluate workplace health, safety, and operational accommodations.
  4. "Normal Contractual Remuneration" means the full salary and pensionable allowances the Employee would receive under their standard employment contract if not absent due to sickness or participating in a phased return, subject to NHS sickness absence pay frameworks.
  5. "Qualifying Period" means the maximum duration of the phased return protocol, not to exceed [Number, e.g., four (4)] calendar weeks unless formally extended in writing by the Employer upon updated clinical advice.
  6. "Supervisory Review" means the mandatory periodic evaluation conducted between the Employee and their designated Line Manager to assess operational performance, physical tolerance, and the ongoing suitability of the Agreed Phased Return Plan.

3. SUBSTANTIVE TERMS & OBLIGATIONS

3.1 Prerequisite Clinical Certification

  1. The Employee shall not be permitted to initiate a phased return to work under this Policy without first submitting a valid, current Fit Note indicating that they are fit for work with adjustments, alongside a formal clearance assessment issued by the OHS.
  2. The Employer reserves the absolute right to mandate an independent medical examination via OHS to verify fitness prior to executing the Agreed Phased Return Plan.

3.2 Terms of the Agreed Phased Return Plan

  1. The specific parameters of the phased return—including reduced daily hours, adjusted workloads, and specific redeployment of clinical or administrative tasks—shall be set forth in Schedule A attached hereto and incorporated by reference.
  2. During the Qualifying Period, the Employee’s performance metrics and output expectations shall be proportionately calibrated to match the agreed working hours and functional restrictions outlined in Schedule A.

3.3 Remuneration and Sickness Pay Integration

  1. Throughout the duration of the Agreed Phased Return Plan (not to exceed the maximum statutory or NHS policy limit of [Number, e.g., four (4)] weeks), the Employee shall receive Normal Contractual Remuneration, notwithstanding their reduced working hours.
  2. Hours worked during the phased return shall not be deemed part-time employment alterations unless a permanent contractual variation is subsequently executed pursuant to Section 3.5.

3.4 Mutual Duties and Representations

  1. Employee Obligations: The Employee warrants that they shall promptly disclose any material deterioration in their health status, adhere strictly to the restrictions outlined in Schedule A, and attend all scheduled Supervisory Reviews and OHS appointments.
  2. Employer Obligations: The Employer warrants that it shall provide a safe working environment, enforce reasonable adjustments, and refrain from assigning duties outside the scope of the Agreed Phased Return Plan or the Employee's clinical capabilities.

3.5 Post-Qualifying Period Transition

  1. Upon the expiration of the Qualifying Period, the Employee shall automatically revert to their full contractual hours and duties, subject to a final clearance review by the Line Manager and OHS.
  2. If clinical evidence demonstrates that the Employee remains unable to resume full duties at the conclusion of the Qualifying Period, the Parties may execute a formal written addendum extending the phased return, or alternatively initiate formal capability or redeployment procedures under NHS terms.

4. DEFAULT, TERMINATION, AND REMEDIES

4.1 Breach Classifications

  1. Minor Breach: Failure by either Party to provide timely notice of a scheduled review meeting, or minor administrative non-compliance that does not directly impact patient safety or employee health.
  2. Material Breach: Any of the following shall constitute an incurable, material breach of this Policy:
    • The Employee undertaking work duties in direct contravention of clinical restrictions, thereby endangering patients, colleagues, or themselves.
    • The Employer unilaterally altering the Employee's duties or hours without prior consultation and written amendment to Schedule A.
    • Fraudulent misrepresentation of health status or falsification of medical documentation by the Employee.

4.2 Notice and Cure Periods

  1. In the event of a remediable material breach, the non-breaching Party shall provide written notice detailing the exact nature of the default.
  2. The breaching Party shall have a strict cure period of thirty (30) business days from receipt of said notice to rectify the default to the reasonable satisfaction of the non-breaching Party.

4.3 Legal Recourse and Remedies

  1. Upon the expiration of the cure period without effective remediation, the non-breaching Party may:
    • Immediately suspend the Agreed Phased Return Plan, reverting the Employee to certified sickness absence status or standard disciplinary/administrative procedures under NHS Trust policy.
    • Seek specific performance or injunctive relief in a court or tribunal of competent jurisdiction.
    • Exercise any other legal or equitable remedy available under the laws of [Jurisdiction].

5. BOILERPLATE LEGAL PROVISIONS

5.1 Severability

If any provision of this Policy is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If no such modification is possible, the provision shall be deemed severed, and the remaining provisions shall remain in full force and effect.

5.2 Entire Agreement

This Policy, inclusive of Schedule A, constitutes the entire understanding and agreement between the Parties with respect to the phased return to work and supersedes all prior negotiations, representations, or informal agreements, whether written or oral.

5.3 Force Majeure

Neither Party shall be held liable for any failure or delay in fulfilling the terms of this Policy if such failure arises from acts of God, war, pandemic, national health emergencies, legal statutory restrictions, or other extraordinary events beyond the reasonable control of the affected Party.

5.4 Governing Law and Jurisdiction

This Policy, and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, the laws of [Jurisdiction]. The Parties irrevocably submit to the exclusive jurisdiction of the employment tribunals and courts of [Jurisdiction].
