1. DOCUMENT PREAMBLE & RECITALS
This Return to Work Policy (the "Agreement") is entered into as of this [Date] (the "Effective Date"), by and between [Company Name], a [State/Country] corporation with its principal place of business at [Address] ("Company"), and the undersigned employee, [Employee Name], residing at [Employee Address] ("Employee").
WHEREAS, the Company requires the physical presence of its personnel to maintain operational efficiency, collaborative output, and corporate culture; and
WHEREAS, the Employee acknowledges that their employment is subject to the Company’s operational requirements, including those necessitating on-site attendance;
NOW, THEREFORE, in consideration of the mutual covenants contained herein and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:
2. OPERATIONAL DEFINITIONS
1.1 "On-Site" shall mean the physical premises of the Company located at [Office Address] or any other location designated by the Company in writing.
1.2 "Core Hours" shall mean the period between [Start Time] and [End Time] local time, during which the Employee must be physically present and performing duties.
1.3 "Hybrid Schedule" shall mean an authorized arrangement requiring the Employee to be On-Site for a minimum of [Number] days per work week.
1.4 "Force Majeure Event" shall mean any act of God, fire, flood, pandemic, government-mandated lockdown, or other cause beyond the reasonable control of the Parties.
1.5 "Default" shall mean the failure of the Employee to perform any material obligation, duty, or responsibility set forth in this Agreement.
3. SUBSTANTIVE TERMS & OBLIGATIONS
2.1 Mandatory Attendance. The Employee agrees to report to the On-Site location in accordance with the Hybrid Schedule or as otherwise directed by the Company. Failure to report constitutes a material breach of employment duties.
2.2 Performance Metrics. The Employee shall maintain performance standards consistent with their job description. Physical attendance is a threshold requirement for the evaluation of performance, and failure to meet attendance requirements shall be grounds for negative performance reviews.
2.3 No Modification of At-Will Status. Nothing in this Agreement shall alter the "at-will" nature of the employment relationship between the Company and the Employee.
2.4 Equipment and Safety. The Company shall provide a safe work environment compliant with [Jurisdiction] occupational health and safety regulations. The Employee agrees to adhere to all established site safety protocols and security procedures.
2.5 Reasonable Accommodations. Any requests for deviation from this policy based on medical or legal requirements must be submitted in writing to the Human Resources Department, accompanied by sufficient documentation, and are subject to the "interactive process" under applicable law.
4. DEFAULT, TERMINATION, AND REMEDIES
3.1 Breach Classifications. A "Material Breach" includes, but is not limited to: (i) three (3) or more unexcused absences from the designated On-Site location in a rolling 30-day period; or (ii) failure to comply with Company safety protocols. 3.2 Notice and Cure. Upon the occurrence of a Material Breach, the Company shall provide written notice to the Employee. The Employee shall have a period of thirty (30) business days from the receipt of such notice to cure the breach to the Company’s reasonable satisfaction. 3.3 Remedies. Failure to cure a Material Breach within the designated period shall constitute grounds for immediate disciplinary action, up to and including termination of employment for cause. The Company reserves all rights to seek equitable relief or monetary damages where applicable by law.
5. BOILERPLATE LEGAL PROVISIONS
4.1 Severability. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force and effect.
4.2 Entire Agreement. This Agreement constitutes the entire agreement between the Parties and supersedes all prior discussions, representations, or agreements, whether written or oral.
4.3 Force Majeure. Neither party shall be liable for any failure to perform its obligations where such failure results from a Force Majeure Event, provided the affected party provides prompt notice to the other party.
4.4 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
4.5 Dispute Resolution. Any dispute arising out of or relating to this Agreement shall be settled by binding arbitration administered by the [Arbitration Association] in accordance with its Employment Arbitration Rules. The seat of arbitration shall be [City, Jurisdiction].
