WHEREAS, the Employee acknowledges that their position requires physical presence at the designated workplace to fulfill their employment duties effectively; and
WHEREAS, the Parties desire to establish binding, mutually understood terms, conditions, and protocols governing the Employee’s transition from remote work or leave status back to the physical workplace;
NOW, THEREFORE, in consideration of the mutual covenants, obligations, and promises contained herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:
2. OPERATIONAL DEFINITIONS
For the purposes of this Agreement, the following terms shall have the meanings ascribed to them below, and such definitions shall apply equally to the singular and plural forms of the terms defined:
- "Alternative Work Arrangement (AWA)" means any approved temporary modification to the standard Return to Work mandate, granted exclusively via written addendum executed by authorized Human Resources personnel.
- "Business Day" means any calendar day, Monday through Friday, excluding official federal, state, or company-recognized holidays observed by the Employer.
- "Core Working Hours" means the mandatory hours of
[Start Time, e.g., 9:00 AM]to[End Time, e.g., 5:00 PM]local time, during which the Employee must be physically present at the Designated Workplace and actively engaged in the performance of their duties. - "Designated Workplace" means the physical office facility, branch, or job site located at
[Workplace Address], or such other facility as the Employer may designate in writing upon thirty (30) calendar days' prior notice to the Employee. - "Disability" means a physical or mental impairment that substantially limits one or more major life activities, as defined under applicable federal, state, or local employment discrimination laws, including the Americans with Disabilities Act (ADA).
- "Force Majeure Event" means any act of God, war, terrorism, riot, civil commotion, pandemic, epidemic, widespread health emergency, governmental action, natural disaster, cyber-attack, or utility failure beyond the reasonable control of the affected Party.
- "Medical Documentation" means official, verified, and contemporaneous records issued by a licensed, board-certified medical physician detailing specific functional limitations and the precise operational accommodations required.
- "Return to Work Date" means
[Return to Work Date], strictly no later than[Time], on which the Employee’s physical attendance at the Designated Workplace becomes mandatory under this Agreement.
3. SUBSTANTIVE TERMS & OBLIGATIONS
3.1 Mandatory Physical Attendance
The Employee is legally and contractually obligated to report to the Designated Workplace on the Return to Work Date and on every subsequent scheduled workday thereafter. Continued remote work is hereby explicitly revoked, except where an Alternative Work Arrangement has been formally executed pursuant to Section 3.4.
3.2 Performance Metrics and Operational Standards
- The Employee shall maintain the same or higher standards of professional conduct, productivity, and performance while working from the Designated Workplace as established in their initial employment agreement and relevant job descriptions.
- The Employee shall clock in, register attendance, or otherwise log operational presence in strict accordance with the Employer's attendance tracking protocols.
- Failure to meet performance metrics resulting from or associated with workplace transition shall not excuse non-compliance with physical attendance mandates.
3.3 Employee Representations and Warranties
The Employee represents and warrants that:
- They possess the legal capacity and authorization to enter into and perform their obligations under this Agreement.
- They are free from any contractual, legal, or other restriction that would prevent them from reporting to the Designated Workplace.
- All information provided by the Employee regarding health, commute, or scheduling constraints is accurate, truthful, and complete.
3.4 Requests for Accommodation
- If the Employee believes they require an accommodation due to a qualifying Disability or legally protected status, they must submit a formal, written request to the Human Resources Department no later than
[Number]calendar days prior to the Return to Work Date. - The request must be accompanied by comprehensive Medical Documentation substantiating the necessity of the accommodation.
- Submission of an accommodation request does not stay, toll, or suspend the Employee’s obligation to report to the Designated Workplace on the Return to Work Date, absent express interim written authorization from the Employer.
3.5 Compliance with Workplace Policies
The Employee agrees to strictly adhere to all existing and subsequently promulgated Employer handbooks, safety protocols, facility security rules, and code of conduct provisions while present at the Designated Workplace.
4. DEFAULT, TERMINATION, AND REMEDIES
4.1 Classification of Breach
Any failure by the Employee to report to the Designated Workplace on the Return to Work Date, unauthorized abandonment of the physical workplace, refusal to adhere to Core Working Hours, or violation of any material obligation under this Agreement shall constitute an immediate material default and breach of the employment relationship.
4.2 Notice and Cure Period
Upon the occurrence of a material default under Section 4.1, the Employer shall issue a written Notice of Breach to the Employee. The Employee shall have a strict, non-renewable cure period of thirty (30) Business Days from the date of receipt of such notice to remedy the default (e.g., by resuming mandatory physical attendance and accounting for unexcused absences).
4.3 Employer Remedies
If the Employee fails to cure the default within the thirty (30) Business Day cure period, the Employer reserves the right to exercise any and all legal, equitable, and contractual remedies available under law and this Agreement, including but not limited to:
- Immediate Termination for Cause: The unilateral termination of the Employee's employment effective immediately upon written notice, forfeiting any severance or discretionary separation benefits.
- Disciplinary Action: Imposition of formal disciplinary measures, suspension without pay, or demotion.
- Injunctive Relief: Seeking temporary, preliminary, or permanent injunctive relief in a court of competent jurisdiction to compel compliance or restrain unauthorized remote work activities.
- Recovery of Damages: Pursuing financial damages for direct economic loss resulting from unexcused absence, operational disruption, or replacement costs.
5. BOILERPLATE LEGAL PROVISIONS
5.1 Severability
If any provision, clause, or section of this Agreement is held to be invalid, illegal, or unenforceable by any court or administrative body of competent jurisdiction, such invalidity shall not affect the remainder of this Agreement. The affected provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
5.2 Entire Agreement
This Agreement, together with any referenced employee handbooks or formal addenda, constitutes the entire understanding and agreement between the Parties concerning the subject matter hereof and supersedes all prior oral or written negotiations, representations, understandings, or agreements between the Employer and the Employee relating to remote work or return-to-work policies.
5.3 Force Majeure
Neither Party shall be held liable or deemed in default for any failure or delay in fulfilling or performing the terms of this Agreement when such failure or delay is caused by, results from, or arises out of a Force Majeure Event. Upon the cessation of the Force Majeure Event, the affected Party shall immediately resume performance of its obligations hereunder, and the Return to Work Date shall be appropriately adjusted by the Employer in writing.
5.4 Governing Law
This Agreement, and all claims or causes of action (whether in contract, tort, or statute) that may be based upon, arise out of, or relate to this Agreement, shall be governed by, enforced under, and construed in accordance with the internal laws of the State/Jurisdiction of [Jurisdiction], without regard to its conflict of laws principles.
