1. DOCUMENT PREAMBLE & RECITALS

THIS RETURN TO WORK AFTER INJURY POLICY AND BINDING COMPLIANCE AGREEMENT (hereinafter the "Agreement") is entered into and made effective as of [Effective Date] (the "Effective Date"), by and between [Company Name], a [State/Country] [Corporation/LLC] having its principal place of business at [Company Address] (hereinafter the "Employer"), and [Employee Name], an individual residing at [Employee Address] (hereinafter the "Employee"). The Employer and the Employee may collectively be referred to herein as the "Parties" and individually as a "Party."

WHEREAS, the Employee has sustained an occupational or non-occupational injury or illness resulting in a temporary or permanent physical or mental impairment;

WHEREAS, the Employer maintains a legal and operational commitment to facilitating the safe, timely, and compliant reintegration of injured or ill employees into the active workforce, consistent with applicable federal, state, and local laws, including but not limited to the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), and applicable Workers' Compensation statutes within the jurisdiction of [Jurisdiction];

WHEREAS, the Parties intend by this Agreement to establish the binding protocols, operational requirements, mutual duties, and performance metrics governing the Employee’s return to work, including provisions for Modified Duty, transitional assignments, and medical compliance;

NOW, THEREFORE, in consideration of the mutual covenants, representations, and warranties set forth herein, and for other good and valuable consideration, the receipt and legal sufficiency of which are hereby mutually acknowledged, the Parties covenant and agree as follows:

2. OPERATIONAL DEFINITIONS

For purposes of this Agreement, the following terms shall have the meanings ascribed below, and such definitions shall apply equally to the singular and plural forms of the terms defined:

  1. "Attending Physician" means the licensed medical doctor, surgeon, or authorized healthcare practitioner primarily responsible for treating the Employee’s Injury and holding legal and professional authority to issue binding medical restrictions and functional capacity evaluations.
  2. "Core Job Functions" means the fundamental, essential duties of the Employee’s position as outlined in the official job description, excluding marginal or non-essential tasks.
  3. "Effective Date" means the date first written above, upon which all operational terms and legal obligations of this Agreement become fully binding upon the Parties.
  4. "Functional Capacity Evaluation (FCE)" means a comprehensive, objective assessment of physical and/or cognitive abilities used to determine the Employee's capacity for work-related activities.
  5. "Injury" means the specific physical or mental harm, trauma, occupational disease, or medical condition—whether originating from an on-the-job incident or personal circumstances—that necessitated the Employee’s medical leave and subsequent evaluation under this Agreement.
  6. "Jurisdiction" means the geographic and legal authority governing this Agreement, specifically the State of [State], inclusive of its statutory labor, employment, and workers' compensation frameworks.
  7. "Medical Clearance" means the formal, written authorization issued by the Attending Physician and approved by the Employer’s designated occupational health specialist, certifying that the Employee is medically stable to resume work duties under specified conditions.
  8. "Modified Duty" means temporary, alternative, or light-duty work assignments that strictly conform to the medical restrictions prescribed by the Attending Physician and do not require the performance of full Core Job Functions.
  9. "Notice Cure Period" means the fixed duration of thirty (30) business days granted to a defaulting Party to rectify a material breach of this Agreement following the issuance of formal written notice.
  10. "Return-to-Work Committee" means the internal administrative body designated by the Employer, comprising representatives from Human Resources, Legal Counsel, and Health, Safety, and Environment (HSE), tasked with overseeing the execution of this Agreement.

3. SUBSTANTIVE TERMS & OBLIGATIONS

3.1 Medical Clearance and Documentation

  1. The Employee shall not return to any active work duties, whether remote or on-site, without first submitting complete, unedited, and authentic documentation of Medical Clearance directly to the Employer’s Human Resources Department.
  2. The Medical Clearance document must explicitly detail all physical and cognitive limitations, restrictions on lifting, standing, sitting, or repetitive motion, and the projected duration of such restrictions.
  3. The Employer reserves the absolute legal right to require a secondary medical examination by an independent physician of its choosing, at the Employer's sole expense, to verify the accuracy of the Medical Clearance.

3.2 Assignment of Modified Duty

  1. In the event that the Employee is medically cleared to work with restrictions that preclude the immediate resumption of Core Job Functions, the Employer may, in its sole discretion, offer a temporary Modified Duty assignment.
  2. The Employee is legally obligated to accept any Modified Duty assignment that complies with the written restrictions issued by the Attending Physician. Unjustified refusal to accept a compliant Modified Duty assignment shall constitute an immediate material breach of this Agreement and may result in the forfeiture of workers' compensation wage-loss benefits, where permissible by the laws of [Jurisdiction].
  3. Modified Duty assignments shall be reviewed on a bi-weekly basis and shall not exceed a maximum cumulative duration of [Number] calendar days, unless an extension is authorized in writing by the Return-to-Work Committee.

3.3 Employee Performance Metrics and Duties

  1. During the term of this Agreement, the Employee shall strictly adhere to all operational schedules, attendance benchmarks, and safety protocols established by the Employer.
  2. The Employee shall immediately report any pain, exacerbation of symptoms, or inability to perform assigned tasks to their direct supervisor and the Human Resources Department within two (2) hours of the occurrence.
  3. The Employee warrants and represents that they are capable of performing the assigned Modified Duty or Core Job Functions safely, without posing a direct threat to the health or safety of themselves or others.

3.4 Employer Accommodations and Obligations

  1. The Employer shall provide a working environment that strictly respects the documented medical restrictions of the Employee.
  2. The Employer shall not require, coerce, or permit the Employee to perform tasks outside the scope of their Medical Clearance.
  3. The Employer shall maintain regular communication with the Attending Physician regarding the Employee’s progress and functional rehabilitation status, subject to applicable medical privacy laws and valid HIPAA/privacy authorizations executed by the Employee.

4. DEFAULT, TERMINATION, AND REMEDIES

4.1 Classification of Breach

The following events shall constitute an immediate material breach of this Agreement:

  1. The submission of fraudulent, falsified, or unauthorized medical documentation by the Employee.
  2. The intentional violation of medical restrictions by the Employee while on company premises or performing work duties.
  3. The unjustified refusal by the Employee to report to an assigned Modified Duty position.
  4. The failure of the Employer to provide reasonable accommodations consistent with certified Medical Clearance.

4.2 Notice and Cure Period

  1. In the event of an alleged material breach of this Agreement, the non-defaulting Party shall provide detailed written notice of default to the defaulting Party, specifying the exact nature of the violation.
  2. The defaulting Party shall have a strict Notice Cure Period of thirty (30) business days from the date of receipt of the written notice to fully cure the specified default.

4.3 Legal Recourse and Remedies

  1. If the Employee fails to cure a material breach within the designated Notice Cure Period, the Employer reserves the right to terminate the Employee's employment immediately, subject to applicable statutory employment protections in [Jurisdiction].
  2. If the Employer fails to cure a material breach within the designated Notice Cure Period, the Employee may pursue all available legal and administrative remedies, including claims for breach of contract or statutory violations before the appropriate administrative agencies or courts of [Jurisdiction].
  3. The prevailing Party in any legal action, arbitration, or formal proceeding arising out of or relating to this Agreement shall be entitled to recover all reasonable attorneys' fees, court costs, and associated litigation expenses from the non-prevailing Party.

5. BOILERPLATE LEGAL PROVISIONS

5.1 Severability

If any provision, clause, or section of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of any other provision herein. This Agreement shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein, and the remaining provisions shall remain in full force and effect.

5.2 Entire Agreement

This Agreement constitutes the entire, final, and exclusive understanding between the Parties with respect to the subject matter hereof, and supersedes all prior negotiations, representations, understandings, and agreements, whether oral or written, between the Parties. No modification, amendment, or waiver of any provision of this Agreement shall be valid unless executed in writing and signed by authorized representatives of both Parties.

5.3 Force Majeure

Neither Party shall be held liable for any failure or delay in the performance of its obligations under this Agreement if such failure or delay arises out of causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor strikes, pandemics, or governmental restrictions, provided that the affected Party gives prompt written notice to the other Party and uses commercially reasonable efforts to resume performance as soon as practicable.

5.4 Governing Law

This Agreement, and all claims, disputes, or causes of action arising out of or relating to it, shall be governed by, construed, and enforced in accordance with the substantive and procedural laws of the State of [State], without regard to its conflict of laws principles.

The arbitration shall be conducted in [City, State], before a single neutral arbitrator. The award rendered by the arbitrator shall be final, and judgment upon the award may be entered in any court having jurisdiction thereof.
