5. STEP-BY-STEP EXECUTION & FILING GUIDE

STEP 1: DRAFTING AND CUSTOMIZATION

  • Open the document in Microsoft Word or Google Docs.
  • Replace all bracketed text [...] with the specific details of the Principal, Attorney, and Property. Ensure names match the government-issued IDs exactly.

STEP 2: STAMP DUTY DETERMINATION

  • Check the local Stamp Act of the State where the Property is located.
  • Purchase non-judicial stamp paper of the requisite value. In many Indian states, a POA for land purchase for a non-blood relative carries a high stamp duty (often equivalent to a Sale Deed), whereas for a blood relative, it is usually a nominal fixed fee.

STEP 3: NOTARIZATION AND APOSTILLE (IF EXECUTED ABROAD)

  • If the Principal is outside India: Sign the document before a Notary Public.
  • Get the document Apostilled (if the country is a member of the Hague Convention) or attested by the Indian Consulate.
  • Send the original to India for "Adjudication" (payment of stamp duty) at the District Registrar's office within 90 days.

STEP 4: REGISTRATION (MANDATORY)

  • The Principal (if in India) or the Attorney must schedule an appointment at the Sub-Registrar's Office.
  • Both the Principal (if available) or the Attorney and two witnesses must appear with original IDs (Aadhar/Passport).
  • The Sub-Registrar will capture biometrics and photographs.

STEP 5: RECORD RETENTION

  • Once registered, the original POA will be returned with a registration number and seal.
  • The Attorney must provide a certified copy of this POA whenever signing documents related to the Property purchase.
  • Retain the original in a secure environment; it is the primary evidence of the Attorney's authority.
