10. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Information Completion: Replace all bracketed fields ([ ]) with the specific legal data for the Principal and Agent. Ensure names match government-issued identification exactly.

  3. Formal Execution:
    • The Principal must sign the document in the presence of a Notary Public.
    • Do not use digital signatures (e.g., DocuSign) unless the remote notarization meets the stringent requirements of Arizona’s Electronic Notarization statutes (A.R.S. § 41-263). Wet-ink signatures are safest for real estate and banking institutional acceptance.
  4. Recording: If the Agent is authorized to act on behalf of the Principal regarding the sale or transfer of real property, this document must be recorded with the County Recorder in the county where the property is located.
  5. Distribution: Provide certified copies to:
    • The Agent.
    • The Principal’s primary financial institutions.
    • The Principal’s estate planning attorney or healthcare provider.
