5. STEP-BY-STEP EXECUTION & FILING GUIDE
- Preparation: Open this document in Microsoft Word or Google Docs. Replace all bracketed fields (e.g.,
[Principal Full Legal Name]) with the accurate, legal information. - Review: The Principal must read the entire document. If specific powers (like real estate) are NOT desired, they should be struck through and initialed.
- Signatory Authority: Ensure the Principal is of sound mind. If there is any doubt, obtain a letter of capacity from a licensed physician.
- Notarization (CRITICAL): Under New Jersey law, a Power of Attorney must be acknowledged by a Notary Public to be recordable. The Principal must sign in the presence of the Notary.
- Witnessing: While NJ law emphasizes the Notary for recordability, two independent witnesses are included here to ensure maximum enforceability across all financial institutions and jurisdictions.
- Digital Signature: If using DocuSign or Adobe Sign, ensure the platform provides a "Certificate of Completion" and that the Notary uses an authorized e-Notary seal compliant with the New Jersey Notary Public Act.
- Filing/Recording: If the Agent will be handling real estate transactions, the original signed and notarized POA MUST be recorded in the Office of the County Clerk in the county where the property is located (N.J.S.A. 46:16-1).
- Distribution: Provide certified copies to the Agent, Successor Agent, and the Principal’s primary financial institutions.
- Retention: The original should be kept in a secure location (e.g., a fireproof safe or with legal counsel), known to the Agent.
