- Open this template in Microsoft Word or Google Docs.
- Perform a global find-and-replace for all bracketed text strings (e.g.,
[Principal Full Legal Name],[Agent Full Legal Name],[Effective Date], etc.) with accurate, verified legal names and data. Ensure zero brackets remain in the final text. - Review Section 5.1 and initial the appropriate box designating whether the power is immediate or springing (contingent upon incapacity).
- Review Section 4 regarding gifting authorities and specialized restrictions.
Step 2: Verification of Signatory Authority and Capacity
- Ensure the Principal possesses full mental capacity (sound mind) and is acting free from duress, fraud, or undue influence at the time of execution.
- Verify that the designated Agent and Successor Agent are legally competent adults (at least 18 years of age) and willing to assume fiduciary duties under Ohio law.
Step 3: Execution and Notarization (Mandatory Requirement)
- Under Ohio law (ORC § 1337.25), a power of attorney must be signed by the Principal (or in the Principal's conscious presence by another individual directed by the Principal to sign the Principal's name) and acknowledged before a Notary Public or other individual authorized by law to take acknowledgments.
