5. STEP-BY-STEP EXECUTION & FILING GUIDE
- Preparation: Open the document in Microsoft Word or Google Docs. Use the "Find and Replace" function to locate all bracketed terms (e.g.,
[Principal Full Legal Name]) and replace them with the actual data. - Witness Selection: Identify two (2) adult witnesses. In Maryland, witnesses must be independent (not the Agent, not the Notary, and preferably not beneficiaries of the Principal's estate).
- Notarization: Schedule a session with a licensed Maryland Notary Public. The Principal and both witnesses must appear before the Notary simultaneously.
- Physical Execution:
- The Principal signs the "FOR THE PRINCIPAL" block.
- The Witnesses sign the "WITNESS ATTESTATION" block.
- The Notary completes the "NOTARY ACKNOWLEDGMENT" and applies their seal.
- The Agent signs the "FOR THE AGENT" block to signify acceptance.
- Digital Archiving: Scan the fully executed original into a high-resolution PDF. If using DocuSign or Adobe Sign for commercial versions, ensure the "Certificate of Completion" is attached to prove the audit trail, though Maryland typically requires physical wet-ink signatures for recordable real estate transactions.
- Filing & Distribution:
- Provide a certified copy to the Agent.
- Deliver copies to the Principal’s financial institutions (Banks, Brokerages).
- Optional: Record the document in the Land Records office of the Maryland County where the Principal owns real property to ensure the Agent can perform real estate transactions.
- Retention: Store the original wet-ink document in a fireproof safe or a bank safe deposit box. Notify the Successor Agent of the location.
