VI. STEP-BY-STEP EXECUTION & FILING GUIDE
- Preparation of Brackets: Open this document in a word processor (Microsoft Word or Google Docs). Use the "Find and Replace" function to locate all bracketed fields (e.g.,
[Principal Full Legal Name]) and input the specific legal details of the parties involved. Ensure the[Governing Jurisdiction]matches the state where the Principal resides. - Verify Signatory Authority: Confirm that the Principal is of legal age (18+) and possesses the mental capacity to understand the document. Confirm that the Agent is not a health care provider at a facility where the Principal is currently receiving care (as prohibited by some state laws).
- Witnessing & Notarization: Most states require either two adult witnesses or a Notary Public. For maximum enforceability across state lines (portability), it is highly recommended to use both two witnesses AND a Notary Public.
- Digital Execution (If Permitted): If using DocuSign or Adobe Sign, ensure the platform provides a "Certificate of Completion" that includes IP addresses, timestamps, and audit trails. Note: Some jurisdictions still require physical "wet ink" signatures for testamentary or power of attorney documents. Check local statutes before using electronic signatures.
- Distribution of Copies: Once fully executed, the Principal must provide copies to:
- The designated Agent and Successor Agent.
- Primary Care Physician (PCP).
- Local hospital where the Principal usually receives care.
- Legal counsel or digital vault for safekeeping.
- Record Retention: The original document should be kept in a secure, accessible location (not a safe deposit box that requires the Principal's signature to open). Retain for a period of no less than the Principal's lifetime plus seven (7) years post-probate.
