V. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Preparation of Brackets: Open this document in Microsoft Word or Google Docs. Use the "Find and Replace" function to locate all square brackets (e.g., [Effective Date]) and input the specific factual data required. Ensure the "Governing Jurisdiction" matches the state where the Principal resides or where the legal matters are primary.
  2. Verify Signatory Authority: If the Agent is a corporation or law firm, ensure the individual signing on behalf of the entity has the documented authority (e.g., a corporate resolution) to bind the company.
  3. Witness and Notary Requirements: Most jurisdictions require a Power of Attorney to be notarized to be "recordable" (filed with a court or land records). Two witnesses are standard practice to prevent challenges to the Principal's capacity.
  4. Digital Execution: If using DocuSign or Adobe Sign, ensure the platform provides a "Certificate of Completion" that includes the IP addresses, timestamps, and tamper-evident seals.
  5. Filing and Record Retention:
    • Provide the original to the Agent.
    • Retain a certified copy in the Principal's permanent legal files.
    • If the Agent is to handle real estate litigation or property transfers, file a copy with the County Recorder’s Office in the relevant jurisdiction.
    • Provide copies to any banks, courts, or opposing counsel involved in the legal matters to establish the Agent's standing.
