11. STEP-BY-STEP EXECUTION & FILING GUIDE
- Drafting: Open this document in a word processor. Replace all bracketed text (e.g.,
[Full Legal Name]) with accurate, legal identification. Do not leave any brackets empty. - Witnessing Requirements: In Alberta, the Powers of Attorney Act requires the Donor to sign in the presence of one witness. The witness must be present at the same time as the Donor. Crucial: The Attorney and the spouse of the Attorney cannot serve as witnesses.
- Capacity: The Donor must be mentally competent at the time of signing. If there is any doubt, the Donor should obtain a letter from a medical professional confirming capacity.
- Digital Signatures: While physical "wet" signatures are the gold standard for real estate and banking, digital signatures (DocuSign/Adobe Sign) are generally accepted if they meet PIPEDA/Electronic Transactions Act standards. Consult with your financial institutions first, as many Alberta banks retain internal policies regarding "wet" signatures for POAs.
- Record Retention: The original document should be kept in a secure, fireproof location. Provide a copy to the Attorney and, if applicable, the Donor’s financial institution.
- Filing: This document does not require registration at the Land Titles Office unless the Attorney intends to deal with specific real property. If real estate transactions are anticipated, consult with a lawyer regarding an "Enduring Power of Attorney" registration.
