5. STEP-BY-STEP EXECUTION & FILING GUIDE
- Preparation of Document: Replace all bracketed fields (
[...]) with the specific legal details of the Principal and Attorney-in-Fact. Ensure the "Governing Jurisdiction" matches the location where the Principal is legally domiciled. - Verify Authority: If the Principal is a corporation, ensure the signatory has a Corporate Resolution authorizing the issuance of this Power of Attorney.
- Physical Signing: While digital signatures (DocuSign/Adobe Sign) are increasingly accepted, international use typically requires "wet-ink" signatures to satisfy foreign government and bank requirements.
- Notarization: The Principal must sign in the presence of a licensed Notary Public. The Notary must apply their official seal.
- Apostille/Legalization (CRITICAL):
- Hague Convention Countries: Take the notarized document to the Secretary of State (or relevant national authority) to obtain an Apostille. This certifies the Notary’s signature for international recognition.
- Non-Hague Countries: The document must be "Legalized." This usually involves certification by the local government followed by the Consulate or Embassy of the country where the document will be used.
- Translation: If using in a non-English speaking country, have the finalized and Apostilled document translated by a Certified/Sworn Translator in the target jurisdiction.
- Record Retention: The Principal should keep the original. Provide a "Certified Copy" to the Attorney-in-Fact. Most international banks will require the presentation of the original or a notarized/Apostilled copy.
- Revocation: To revoke, execute a "Revocation of Power of Attorney," notarize it, and provide copies to all financial institutions where the original PoA was filed.
