4. OPERATIVE CLAUSES & STATUTORY OBLIGATIONS

4.1 Condition Report

The Landlord must provide the Tenant with two copies of a signed Condition Report before or on the date the Tenant moves into the Premises. The Tenant must complete, sign, and return one copy of the Condition Report to the Landlord within 3 business days of taking possession.

4.2 Quiet Enjoyment

The Landlord shall take all reasonable steps to ensure the Tenant has quiet enjoyment of the Premises during the tenancy term, barring lawful entries executed in strict accordance with section 86 of the Residential Tenancies Act 1997 (Vic).

4.3 Maintenance, Repairs, and Modifications

  • Urgent Repairs: Urgent repairs as defined under the Act (including burst water pipes, dangerous electrical faults, failure or breakdown of any cooling, heating or hot water service) must be addressed immediately pursuant to emergency channels outlined in the Condition Report.

4.4 Use of Premises

The Tenant shall use the Premises primarily as a residential dwelling. The Tenant shall not:

  1. Use the Premises, or permit them to be used, for any illegal purpose.
  2. Cause a nuisance or interfere with the reasonable peace, comfort, or privacy of neighbors.

4.5 Subletting and Assignment
