5. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Review and Customization: Open the master document in Microsoft Word or Google Docs. Replace all bracketed placeholder text (e.g., [Client Full Legal Name], [State / Jurisdiction]) with verified legal data. Ensure all mutual initial selections ([ ]) reflect the precise personal, ethical, and clinical preferences of the Principal.
  2. Statutory Compliance Audit: Before finalizing, verify the specific execution formalities mandated by the health and safety code of the governing state. Certain jurisdictions require specific statutory warning legends to be printed in capital letters directly above the signature block, or mandate specific combinations of disinterested witnesses and formal notary acknowledgments.
  3. Signatory Verification: Ensure the Principal possesses legal capacity at the moment of execution. Verify that the nominated Primary and Successor Agents are fully informed of their appointments, accept their fiduciary duties, and possess copies of the executed instrument.
  4. Digital or Wet-Ink Execution:
    • Wet-Ink (Recommended for Health Directives): Print the finalized document on standard bond paper. Execute in the physical presence of the required witnesses and a licensed Notary Public.
    • Digital Execution: If utilizing electronic signature platforms (such as DocuSign or Adobe Sign), ensure that the platform complies with the Electronic Signatures in Global and National Commerce Act (E-Sign Act) and the Uniform Electronic Transactions Act (UETA), noting that some states restrict electronic execution of healthcare powers of attorney.
  5. Distribution and Record Retention:
    • Provide the original executed document to the Primary Agent in a secure, accessible location (do not lock in a bank safe deposit box inaccessible during medical emergencies).
    • Provide authenticated copies to the Principal’s primary care physician, specialists, and local hospital networks for inclusion in the Principal's electronic health record (EHR).
    • Maintain a digital copy in an encrypted, cloud-accessible repository with emergency access credentials provided to the Agent.
