If the primary Agent named herein is unable or unwilling to serve, resigns, dies, or becomes legally incapacitated, the Principal hereby appoints the Successor Agent named above to act with all the same powers, duties, and immunities conferred upon the primary Agent. Third parties may rely upon a written affidavit executed by the Successor Agent certifying the occurrence of any such disqualifying event regarding the primary Agent.

SECTION 5. DURABILITY / EFFECTIVENESS

Select one option by initialing or striking through:

  • Non-Durable: This Power of Attorney shall terminate upon the subsequent disability or incapacity of the Principal.
