| | | |
| v v |
| [4. Third-Party Dissemination] <-------------------------------------- [5. Record Retention] |
+--------------------------------------------------------------------------------------------------+
Step 1: Document Customization and Drafting
- Open the document in your contract management platform, Microsoft Word, or Google Docs.
- Utilize the search-and-replace command (
Ctrl+HorCmd+H) to locate and populate every bracketed entry:- Identify all full legal names matching government-issued identification (Passports, Real ID Driver's Licenses).
- Enter complete physical addresses, including apartment or suite numbers.
- Accurately insert the Children's dates of birth and partial social security numbers for identification tracking.
- Check the maximum legal period permitted by your state. Many states (e.g., Arizona, Colorado, Michigan, and others under the Uniform Probate Code § 5-105) cap parental delegation powers via POA at six (6) months (or twelve (12) months in certain jurisdictions). If deployment or travel exceeds this limit, execute sequential documents or initiate formal temporary court guardianship.
Step 2: Verification of Signatory Authority and Capacity
- Confirm both parents/legal guardians sign unless:
- One parent has sole legal custody pursuant to a valid, final family court decree (attach a certified copy of the custody order to this POA);
- One parent is deceased (attach a copy of the death certificate); or
- The non-signing parent's rights have been terminated.
- Confirm the Agent is an adult (at least 18, preferably 21) who has completed a background review and does not possess conflicting disqualifying records.
Step 3: Formal Execution, Notarization, and Witnessing
- Physical Execution:
- Both Principals must sign the instrument before two (2) independent, non-relative adult witnesses and one (1) Notary Public.
- The Agent must sign the Acceptance of Appointment.
- Digital Execution (DocuSign / Adobe Sign / Remote Online Notarization - RON):
- Ensure your jurisdiction explicitly authorizes electronic signatures and RON for family powers of attorney.
- Generate an auditable digital certificate trail (IP addresses, identity-proofing audit logs, timestamps).
Step 4: Dissemination to Third Parties
Distribute certified or clear photostatic copies of the fully executed document to the following entities:
- Healthcare Entities: Primary care pediatricians, pediatric dentists, preferred urgent care facilities, and local emergency rooms.
- Educational Entities: Primary/secondary school registrars, guidance offices, and daycare center directors.
- Logistics & Travel: If the child is traveling internationally, provide the Agent with:
- The executed, notarized POA;
- An additional notarized Minor International Travel Consent Affidavit; and
- The original physical passports of the Children.
Step 5: Record Retention and Revocation Protocol
- Master File: Retain the physical original wet-ink document in a fireproof secure lockbox at the Principals' primary residence or in the care of institutional family legal counsel.
- Agent Copy: Provide one duplicate original or high-resolution PDF copy to the Agent to be maintained on their mobile device or in their travel binder.
- Formal Revocation: To terminate the power prior to the scheduled Expiration Date, execute a written "Notice of Revocation of Power of Attorney," serve it via certified mail with return receipt requested upon the Agent, and immediately deliver written notice to every healthcare provider, school, and third party that previously received the POA.
