3. OPERATIVE CLAUSES & TERMS
1. DURATION AND COMMENCEMENT
1.1. This Lease shall endure for a fixed period of [Number] months, commencing on [Start Date] and terminating on [End Date] (the "Lease Period"), without the necessity of notice unless otherwise agreed in writing.
1.2. Upon expiration of the Lease Period, this Agreement shall not tacitly relocate (huur gaat voor koop or tacit relocation is expressly excluded). 2. RENTAL AND PAYMENT TERMS

3. UTILITIES AND MUNICIPAL CHARGES
3.1. The Tenant shall be solely liable for and shall pay all consumption charges for electricity (prepaid meter token purchases or ZESA billing), water, sewerage, and refuse removal levied by the local authority ([e.g., City of Harare / Bulawayo City Council]) or statutory distributor for the duration of the Lease.
3.2. Where municipal bills are rendered directly to the Landlord, the Tenant shall reimburse the Landlord within five (5) business days of presentation of the invoice.
4. SECURITY DEPOSIT
4.1. Upon signature of this Agreement, the Tenant shall deposit with the Landlord the sum of USD [Deposit Amount] as a Security Deposit.
4.2. The Deposit shall be held in trust without interest accruing to the Tenant, as security for the due fulfillment of all obligations under this Agreement.
4.3. The Landlord shall be entitled to apply the Deposit, or any portion thereof, toward remedying breaches of this Agreement, including unpaid utilities, damage to the Premises (fair wear and tear excepted), or unpaid rental.
4.4. The balance of the Deposit, if any, shall be refunded to the Tenant within twenty-one (21) business days following the vacating of the Premises and completion of the outgoing inspection, less documented deductions.
5. USE OF PREMISES
5.1. The Premises shall be used exclusively for residential purposes by the Tenant and the following permitted occupants only: [List Names of Occupants / Dependants].
5.2. The Tenant shall not sub-let the Premises, cede this Agreement, or part with possession of the Premises in whole or in part without the prior express written consent of the Landlord.

6. MAINTENANCE, REPAIRS, AND IMPROVEMENTS
6.1. The Tenant acknowledges receipt of the Premises in good, clean, and tenantable condition, supported by the Incoming Inspection Report (Annexure A). 6.2. The Tenant shall, at their own expense, maintain the interior of the Premises, doors, windows, electrical fittings, and plumbing fixtures in good working order, fair wear and tear excepted. 6.3. The Landlord shall be responsible for structural maintenance, roof integrity, external painting, and major foundational repairs, provided such damage is not caused by the negligence or misuse of the Tenant or their invitees. 6.4. The Tenant shall not make structural alterations, affix permanent fixtures, or paint the Premises without the Landlord's prior written consent. Any unauthorized improvements shall accrue to the Landlord without compensation upon termination.
7. INSPECTION
7.1. Joint incoming and outgoing inspections shall be conducted by both parties. 7.2. The Landlord or their duly authorized agent reserves the right to enter the Premises upon giving reasonable notice (not less than twenty-four [24] hours) to inspect the condition thereof or to effect necessary repairs.
8. BREACH AND TERMINATION
8.1. If the Tenant fails to pay the Rental by the Due Date, or breaches any other material term of this Agreement and fails to remedy such breach within seven (7) calendar days of receiving written notice demanding remedy, the Landlord shall be entitled, without prejudice to any other legal remedies:
- 8.1.1. To cancel this Agreement immediately, repossess the Premises, and evict the Tenant; or
- 8.1.2. To claim immediate payment of all arrear rentals and damages for the unexpired remainder of the Lease Period. 8.2. The Tenant shall pay interest on all overdue amounts at the maximum prescribed legal rate under Zimbabwean law from the due date until the date of full settlement.
9. DOMICILIUM CITANDI ET EXECUTANDI
9.1. The parties choose the following physical addresses as their respective domicilium citandi et executandi for all notices, legal processes, and communications under this Agreement:
