WHEREAS, Landlord is the lawful owner of the residential real property located at [Property Street Address, City, State, Zip Code] (the "Premises"); and

WHEREAS, Landlord desires to lease the Premises to Tenant, and Tenant desires to lease the Premises from Landlord, subject to the terms, covenants, conditions, and provisions hereinafter set forth;

NOW, THEREFORE, for and in consideration of the mutual covenants, obligations, and valuable consideration exchanged herein—the receipt and sufficiency of which are hereby acknowledged—the Parties agree as follows:

2. OPERATIONAL DEFINITIONS

For the purposes of this Agreement, the following terms shall have the meanings ascribed to them below, and such definitions shall apply equally to the singular and plural forms of the terms defined:

  1. "Agreement" means this Residential Lease Agreement, including all exhibits, addenda, and riders attached hereto and incorporated by reference.
  2. "Base Rent" means the fixed monthly financial consideration paid by Tenant to Landlord for the exclusive right to use and occupy the Premises, excluding utilities, security deposits, and other ancillary charges.
  3. "Default" means the failure of either Party to perform, observe, or comply with any material covenant, condition, agreement, or term of this Agreement within the applicable cure period designated herein.
  4. "Effective Date" means the date first written above, upon which both Parties have fully executed this Agreement.
  5. "Force Majeure" means acts of God, natural disasters, war, civil unrest, acts of terrorism, epidemics, pandemics, governmental embargoes, utility failures beyond reasonable control, or other catastrophic events rendering performance commercially impossible.
  6. "Interest Rate" means the lesser of eighteen percent (18%) per annum or the maximum rate permitted by applicable law of the Jurisdiction.
  7. "Jurisdiction" means the state, province, or territory in which the Premises is physically located, specifically [State/Province].
  8. "Landlord" means the owner of the Premises or an authorized agent holding explicit legal authority to bind the owner.
  9. "Lease Term" means the fixed duration of this tenancy, commencing on [Lease Start Date] (the "Commencement Date") and expiring at 11:59 PM on [Lease End Date] (the "Expiration Date").
  10. "Notice" means any formal communication required or permitted under this Agreement, delivered strictly in accordance with the notice provisions set forth herein.
  11. "Premises" means the residential dwelling located at [Property Street Address, City, State, Zip Code], including any designated parking spaces, storage units, and appurtenant fixtures, but explicitly excluding any areas reserved by Landlord.
  12. "Security Deposit" means the financial sum deposited by Tenant with Landlord to secure performance of Tenant’s obligations under this Agreement against damages, unpaid rent, or other breaches.
  13. "Tenant" means all natural persons executing this Agreement as occupants of the Premises, jointly and severally.

3. SUBSTANTIVE TERMS & OBLIGATIONS

3.1 Grant of Lease and Term

Landlord hereby leases the Premises to Tenant, and Tenant hereby takes and hires the Premises from Landlord, for the Lease Term. The tenancy shall commence on the Commencement Date and shall terminate on the Expiration Date without the necessity of formal notice, unless renewed by mutual written agreement of the Parties.

3.2 Rent Payment Obligations

  1. Base Rent Amount: Tenant covenants and agrees to pay to Landlord Base Rent in the monthly amount of [Dollar Amount] ($[Numeric Amount]), due and payable in advance on or before the first (1st) calendar day of each successive calendar month during the Lease Term.
  2. Payment Mechanics: Rent shall be paid via electronic transfer, automatic clearing house (ACH), or personal check payable to [Landlord/Entity Name] at [Payment Remittance Address], or via such other method as Landlord may designate in writing. Cash payments are strictly prohibited.
  3. Prorated Rent: For the partial initial month commencing on [Commencement Date], Tenant shall pay a prorated Base Rent amount of [Dollar Amount] ($[Numeric Amount]) on or before the Commencement Date.
  4. Late Charges: If Base Rent is not received by Landlord by 11:59 PM on the fifth (5th) calendar day of the month, Tenant shall pay a late fee equal to [Percentage]% of the monthly Base Rent or [Dollar Amount], whichever is greater, as liquidated damages for administrative costs, without prejudice to Landlord’s other remedies.
  5. Returned Check Fee: Any check or electronic payment returned for insufficient funds (NSF) or stopped payment shall incur a service fee of [Dollar Amount] ($[Numeric Amount]), in addition to any applicable late charges.

3.3 Security Deposit

  1. Deposit Amount: Upon execution of this Agreement, Tenant shall deposit with Landlord the sum of [Dollar Amount] ($[Numeric Amount]) as a Security Deposit.
  2. Holding and Return: The Security Deposit shall be held by Landlord in accordance with the laws of the Jurisdiction. Within [Number, e.g., 30] days following the expiration or termination of this Agreement and surrender of the Premises, Landlord shall return the Security Deposit to Tenant, less any lawful deductions for unpaid rent, utility charges, cleaning costs, and damages exceeding ordinary wear and tear, accompanied by an itemized accounting statement of deductions.

3.4 Use and Occupancy

  1. Residential Purpose: The Premises shall be used and occupied exclusively as a private single-family residential dwelling and for no other purpose.
  2. Occupants: The Premises shall be occupied strictly by the Tenant and the following authorized minor dependents: [List Names or "None"]. Subletting, assignment, or allowing unauthorized occupants to reside on the Premises for more than [Number] consecutive days without Landlord's prior written consent constitutes a material breach.
  3. Compliance with Law: Tenant shall comply with all federal, state, municipal, and local laws, ordinances, building codes, and homeowners' association (HOA) bylaws applicable to the Premises.

3.5 Maintenance, Repairs, and Alterations

  1. Tenant Maintenance: Tenant shall keep the Premises in a clean, sanitary, and safe condition. Tenant shall promptly notify Landlord of any structural defects, water leaks, or mechanical failures. Tenant shall bear the cost of repairs rendered necessary by the intentional acts, negligence, or misuse of Tenant, their guests, or pets.
  2. Landlord Maintenance: Landlord shall maintain the structural integrity, roof, foundation, plumbing, electrical, heating, and air conditioning systems in good working order, subject to ordinary wear and tear, and in compliance with statutory habitability requirements.
  3. Alterations: Tenant shall not make any structural alterations, paint, wallpaper, install security systems, or affix fixtures to the Premises without the prior express written consent of Landlord. Any authorized improvements shall become the property of Landlord upon expiration of the Lease Term.

3.6 Utilities and Services

Tenant shall be solely responsible for arranging and paying for all utility services consumed on the Premises during the Lease Term, including but not limited to electricity, gas, water, sewer, internet, and cable television, with the exception of [List Landlord-paid utilities, e.g., trash removal / HOA dues], which shall be paid by Landlord.

3.7 Access and Inspection

Landlord, or Landlord’s designated agents, reserve the right to enter the Premises upon giving Tenant not less than twenty-four (24) hours' prior notice (except in cases of documented emergency) to inspect the property, make necessary repairs, exhibit the Premises to prospective purchasers, lenders, or tenants, or verify compliance with this Agreement.

3.8 Insurance and Liability

Landlord’s property insurance policy does not cover Tenant’s personal property or liability. Tenant is strongly advised to obtain and maintain a comprehensive renter’s (HO-4) insurance policy throughout the Lease Term, providing personal liability coverage of not less than [Dollar Amount, e.g., $100,000]. Tenant releases Landlord from liability for any damage to personal property except where caused by Landlord’s gross negligence or willful misconduct.

4. DEFAULT, TERMINATION, AND REMEDIES

4.1 Events of Default

The occurrence of any one or more of the following events shall constitute a material Default by Tenant under this Agreement:

  1. Failure of Tenant to pay Base Rent, late fees, or any other financial obligation within five (5) calendar days of its due date;
  2. Failure of Tenant to perform or observe any non-monetary covenant, condition, or obligation contained in this Agreement;
  3. Abandonment or vacation of the Premises by Tenant for a period exceeding fourteen (14) consecutive days without prior written notice to Landlord;
  4. The filing of a petition in bankruptcy by or against Tenant, or an assignment for the benefit of creditors;
  5. The misrepresentation or falsification of any material fact on Tenant’s rental application.

4.2 Notice and Cure Periods

Except where expressly stated otherwise in this Agreement, Landlord shall provide Tenant with written notice specifying the exact nature of the Default. Tenant shall have thirty (30) business days from the date of formal receipt of such notice to cure any non-monetary Default. For monetary Defaults (unpaid rent), Tenant shall have a strict cure period of five (5) business days following written notice of non-payment.

4.3 Landlord Remedies

Upon the occurrence of an uncured Default, Landlord may, at its sole discretion and without prejudice to any other legal or equitable rights, exercise any of the following remedies:

  1. Termination of Lease: Terminate this Agreement and Tenant’s right of possession upon written notice, demanding immediate surrender of the Premises;
  2. Eviction and Possession: Initiate legal eviction proceedings (Unlawful Detainer or summary ejectment) through a court of competent jurisdiction to recover possession of the Premises;
  3. Damages: Recover all unpaid Base Rent, prorated rent through the end of the Lease Term or until re-rented, late fees, costs of repair, and reasonable attorney’s fees and court costs incurred in enforcing Landlord’s rights;
  4. Mitigation of Damages: Landlord shall use commercially reasonable efforts to mitigate damages by re-renting the Premises, but Tenant remains liable for any financial shortfall resulting from a re-rental at a lower rate or during vacancy periods.

4.4 Tenant Remedies

If Landlord fails to perform any material obligation imposed by this Agreement or statutory habitability requirements, Tenant shall deliver written notice specifying the failure. Landlord shall have thirty (30) business days to cure such failure. If Landlord fails to cure within said period, Tenant may pursue remedies available under the laws of the Jurisdiction, which may include constructive eviction claims or statutory repair-and-deduct remedies, provided Tenant is not otherwise in Default.

5. BOILERPLATE LEGAL PROVISIONS

5.1 Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions of this Agreement shall remain in full force and effect and shall in no way be impaired or invalidated.

5.2 Entire Agreement

This Agreement, including any referenced addenda and exhibits, constitutes the final, complete, and exclusive statement of the agreement between the Parties pertaining to the subject matter hereof, and supersedes all prior oral or written negotiations, understandings, representations, and agreements. No amendment or modification of this Agreement shall be binding unless executed in writing by both Parties.

5.3 Force Majeure

5.4 Governing Law and Venue

This Agreement shall be governed by, construed, and enforced in accordance with the substantive laws of the Jurisdiction ([State/Province]), without regard to its conflict of laws principles. Any legal action, proceeding, or arbitration arising out of this Agreement shall be instituted exclusively in the state or federal courts located within [County Name] County, [State/Province], and the Parties hereby consent to the personal jurisdiction of such courts.

5.5 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, or validity thereof, shall first be subjected to good-faith mediation between the Parties. If mediation fails to resolve the dispute within thirty (30) days, the matter shall be submitted to binding arbitration administered by [Arbitration Organization, e.g., the American Arbitration Association] in accordance with its commercial arbitration rules, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

5.6 Waiver

The waiver by either Party of any breach of any term, covenant, or condition herein shall not operate as a waiver of any subsequent breach of the same or any other term, covenant, or condition. No waiver shall be valid unless executed in writing by the waiving Party.

5.7 Notices

All notices, demands, or requests required or permitted under this Agreement must be in writing and shall be deemed properly delivered when: (a) delivered personally; (b) sent by certified mail, return receipt requested, postage prepaid; or (c) sent by a nationally recognized overnight courier service, addressed to the respective Parties at their designated addresses set forth in the Preamble, or to such other address as a Party may designate by written notice.
