Operative Terms

1. Design Specifications: The Bakery shall produce a cake based on the following details: [Description of flavors, tiers, colors, and themes]. Any changes requested by the Client after the execution of this Agreement must be submitted in writing and may result in additional charges.

2. Payment Terms: A non-refundable deposit of [Amount] is due upon execution of this Agreement. The remaining balance of [Amount] is due no later than [Number] days prior to the Event Date. Failure to pay the balance by the due date may result in cancellation of the order.

3. Cancellation & Refunds: If the Client cancels this order at least [Number] days prior to the Event Date, the Client shall forfeit the deposit but will not be liable for the balance. Cancellations made within [Number] days of the Event Date remain subject to the full contract price.

4. Allergy Disclosure: The Client acknowledges that the Bakery handles common allergens, including but not limited to nuts, dairy, wheat, and eggs. The Bakery is not responsible for any adverse reactions caused by cross-contamination.

5. Transportation & Liability: Once the product leaves the Bakery's possession (or is accepted by the Client at the venue), the Bakery is no longer liable for any damage, melting, or structural failure. The Client is responsible for ensuring a stable, level surface for the cake at the venue.

6. Force Majeure: Neither party shall be held liable for failure to perform duties due to events beyond their reasonable control, including acts of God, extreme weather, or public health emergencies.
