3. OPERATIVE CLAUSES & TERMS

3.1 Informed Consent to Participate

Releasor hereby acknowledges, covenants, and agrees that they have voluntarily chosen to participate in the Authorized Activity. Releasor confirms that they are in proper physical and mental condition to participate in said Activity and assume all associated risks, known and unknown, foreseen and unforeseen.

3.2 Assumption of Risk

Releasor explicitly recognizes and assumes all risks associated with the Authorized Activity, including but not limited to bodily injury, illness, property damage, economic loss, or death. Releasor acknowledges that these risks may arise from the acts, omissions, or negligence of Releasee, its officers, directors, employees, agents, or independent contractors.

3.3 Release and Waiver of Liability

To the fullest extent permitted by applicable law, Releasor, on behalf of themselves, their heirs, assigns, personal representatives, and next of kin, hereby releases, acquits, and forever discharges Releasee, its parent companies, subsidiaries, affiliates, officers, directors, shareholders, employees, agents, and insurers from any and all liabilities, claims, demands, losses, or causes of action arising out of or related to any property damage, economic loss, physical or mental injury, or death sustained by Releasor during or in connection with the Authorized Activity.

3.4 Indemnification and Hold Harmless

Releasor agrees to defend, indemnify, and hold harmless Releasee from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind (including reasonable attorneys' fees) arising out of or resulting from any third-party claim related to Releasor's negligence, willful misconduct, or breach of this Agreement.

3.5 Media and Publicity Release

Releasor hereby grants Releasee and its legal representatives and assigns an irrevocable, perpetual, worldwide, royalty-free license to use, publish, reproduce, distribute, and display Releasor’s name, voice, likeness, image, and biographical material captured during the Authorized Activity in any and all media now known or hereafter devised, for any lawful commercial, promotional, or institutional purpose, without further compensation, notice, or approval.

3.6 Medical Treatment Authorization

In the event of an emergency, Releasor hereby authorizes Releasee to secure any necessary medical treatment, hospitalization, or medication for Releasor. Releasor assumes sole financial and legal responsibility for all costs incurred in connection with any such medical emergency intervention.

3.7 Governing Law and Dispute Resolution
