1. STATUTORY & LEGAL COMPLIANCE NOTICE
CRITICAL LEGAL ADVICE DISCLAIMER: This document is an institutional-grade template designed to establish a clear, non-employment-based legal relationship between an Australian incorporated entity and a volunteer. Under Australian law (including the Fair Work Act 2009 (Cth) and relevant state-based work health and safety legislation, incorporated associations acts, and charitable fundraising acts), the distinction between an employee and a volunteer is strictly construed based on the real substance, practical reality, and legal nature of the relationship, rather than the mere nomenclature used in a contract.
Key legal indicators of a genuine voluntary relationship include the absence of an entitlement to wages, the absence of an expectation of remuneration or commercial gain, the charitable, community, or educational objectives of the organization, and the true freedom of the volunteer to accept or reject tasks. Misclassifying an employee as a volunteer exposes the organization to severe statutory penalties, back-pay claims for minimum wages, superannuation guarantee shortfalls, and workers' compensation liabilities.
Both parties acknowledge that they have independently assessed or sought independent legal and financial advice regarding the tax, liability, and regulatory implications of entering into this Agreement.

4.4 Moral Rights Consent. To the maximum extent permitted by the Copyright Act 1968 (Cth), the Volunteer unconditionally and irrevocably consents to any act or omission by the Organization, its successors, assigns, and licensees, that would otherwise constitute an infringement of the Volunteer’s moral rights in relation to the Work Product (including failure to attribute authorship or derogatory treatment of the work).
