4. OPERATIVE CLAUSES & TERMS

4.1 Payment of Rent

  1. The Tenant must pay the rent on or before the due date specified in Item 3.
  2. The Lessor/Agent must keep a record of rent paid and provide a receipt or ledger in compliance with the RTRAA.

4.2 Rental Bond

  1. The Tenant must pay the Rental Bond to the Lessor/Agent upon execution of this Agreement.
  2. The Lessor/Agent must remit the Bond to the Residential Tenancies Authority (RTA) within the statutory timeframe (10 days under the RTRAA) along with a completed Bond Lodgement form.
  3. Bond claims and refunds will be processed strictly in accordance with Part 3 of the RTRAA.

4.3 Outgoings & Utilities

  1. The Tenant is responsible for the connection and payment of all utility services supplied to the Premises that are separately metered (e.g., electricity, gas, internet).
  2. Pursuant to the RTRAA, the Tenant is only required to pay for water consumption if the Premises are individually metered, water efficient devices are installed, and the property meets specific minimum efficiency standards.

4.4 Maintenance, Repairs, and Alterations

  1. The Tenant must maintain the Premises in a clean, tenantable condition, fair wear and tear excepted, and notify the Lessor/Agent of any damage or required maintenance promptly.
  2. The Tenant shall not make any alterations, additions, or structural modifications to the Premises without the prior written consent of the Lessor.
  3. The Lessor must maintain the Premises in a fit state for habitation and carry out necessary urgent and non-urgent repairs in compliance with statutory timeframes.

4.5 Entry by Lessor / Agent

  1. The Lessor/Agent may only enter the Premises in accordance with the notice periods and statutory grounds prescribed under sections 192–209 of the RTRAA (e.g., routine inspections conducted no more than once every 3 months, emergency access, or carrying out repairs).

4.6 Breach, Termination, and Remedy

  1. If either party breaches a term of this Agreement, the aggrieved party may issue a Notice to Remedy Breach providing the statutory remedy period.
  2. Termination of this Agreement by either party must be executed strictly in accordance with the mandatory forms and notice periods set out in the RTRAA.
