1. PARTIES

2. PREMISES

Sub-letting or assignment without the Landlord’s prior written consent is strictly prohibited. 5.2 Maintenance: The Tenant shall maintain the interior of the Premises in good tenantable repair. The Landlord shall be responsible for structural repairs. 5.3 Utilities: The Tenant shall be solely responsible for the payment of electricity, water, and other utility charges directly to the relevant utility providers. 5.4 Inspection: The Landlord reserves the right to enter the Premises at reasonable hours with at least [24/48] hours' prior notice to inspect the state of repair. 5.5 Termination: Any breach of these terms allows the Landlord to re-enter the Premises in accordance with the provisions of the Rent Act, 1963.

STEP-BY-STEP EXECUTION GUIDE

1. Due Diligence: Verify property ownership via a Land Title Search at the Lands Commission. Ensure the Landlord has the legal capacity to lease the property before transferring funds.
2. Execution: Ensure both parties and their respective witnesses sign the document. It is standard practice in Ghana for the Tenant to provide two passport-sized photographs to the Landlord for security documentation.
3. Stamp Duty: To ensure the document is admissible in a Ghanaian court, present the signed agreement to the Ghana Revenue Authority (GRA) to pay the requisite Stamp Duty.
4. Registration/Compliance: If the lease exceeds 3 years, it must be registered with the Lands Commission. For shorter terms, ensure the rent paid is within the legal limits prescribed by the local Rent Control Officer to avoid future litigation.
