PARTIES & DEFINITIONS

  1. OPERATIVE CLAUSES & TERMS

1. RENT PAYMENT & REVIEW

1.1 The Tenant shall pay the Rent to the Landlord’s designated bank account ([Bank Name], Account Name: [Account Name], Account Number: [Account Number], Branch: [Branch Name]) on or before the [Day] day of each rental period without deduction or set-off. 1.2 Time is of the essence regarding the payment of Rent. 1.3 Rent shall remain fixed for the duration of the Term. 2. SECURITY DEPOSIT

2.1 Upon execution of this Agreement, the Tenant shall deposit with the Landlord the sum of [ZMW Amount] representing [Number] months' rent as a Security Deposit. 2.2 The Security Deposit shall be held by the Landlord as security for the faithful performance by the Tenant of all terms, covenants, and conditions of this Agreement. 2.3 The Landlord shall refund the Security Deposit to the Tenant within thirty (30) days following the expiration of this Agreement and vacant possession of the Premises, subject to the deduction of any reasonable costs incurred in rectifying breaches of tenant obligations, unpaid utilities, or physical damage beyond fair wear and tear.

3. UTILITIES AND RATES

3.1 The Tenant shall be solely responsible for and shall promptly pay all charges for electricity (ZESCO), water and sewerage (e.g., Lusaka Water Supply and Sanitation Company or local municipal utility), internet, and gas consumed on the Premises during the Term. 3.2 The Landlord shall remain responsible for the payment of property rates levied by the local council.

4. USE OF PREMISES

4.1 The Premises shall be used strictly as a private single-family residential dwelling and for no other purpose whatsoever. 4.2 The Tenant shall not assign, sublet, or part with possession of the whole or any part of the Premises without the prior written consent of the Landlord, which consent shall not be unreasonably withheld. 4.3 The Tenant shall not carry out any illegal, immoral, or hazardous activities on the Premises, nor cause any nuisance, annoyance, or disturbance to neighboring occupiers.

5. MAINTENANCE, REPAIRS, AND ALTERATIONS

5.1 The Landlord shall maintain the structural elements of the Premises, including the roof, main walls, foundations, and external plumbing and electrical mains, in a tenantable condition pursuant to statutory obligations. 5.2 The Tenant shall keep the interior of the Premises, including all interior fixtures, fittings, windows, doors, and sanitary apparatus, in good, clean, and tenantable repair and condition (fair wear and tear excepted). 5.3 The Tenant shall not make any structural alterations, additions, or improvements to the Premises without the express prior written consent of the Landlord.

6. INSPECTION

6.1 The Landlord or the Landlord’s authorized agent shall be permitted, upon giving reasonable notice of not less than forty-eight (48) hours (except in cases of emergency), to enter the Premises at reasonable daylight hours to inspect the condition thereof and execute necessary repairs.

7. TERMINATION AND DEFAULT

7.1 If the Rent or any part thereof remains unpaid for fourteen (14) days after becoming due (whether formally demanded or not), or if the Tenant breaches any other covenant herein and fails to remedy such breach within fourteen (14) days of receiving written notice from the Landlord, the Landlord shall be entitled to re-enter the Premises or any part thereof in the name of the whole and determine (terminate) this Agreement, without prejudice to any antecedent claims or remedies. 7.2 Either party may terminate this Agreement prior to the expiration of the Term by providing [Number, e.g., 60] days' written notice to the other party, or payment in lieu thereof.

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1 This Agreement shall be governed by, construed, and enforced in accordance with the laws of the Republic of Zambia. 8.2 Any dispute arising out of or in connection with this Agreement shall first be referred to mediation. If unresolved, the dispute shall be submitted to the jurisdiction of the Rent Tribunal or the courts of competent jurisdiction in Zambia.
