V. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Field Completion: Open this document in Microsoft Word or Google Docs. Populate all bracketed information [...] with absolute precision. Use the "Legal Description" exactly as it appears on the most recent Deed for the property.
  2. Verify Authority: Ensure the Principal has the legal right to grant these powers (e.g., they are the sole owner or have a corporate resolution if the owner is an entity).
  3. Witnessing Requirements: Most jurisdictions require at least two (2) disinterested witnesses (persons not related to the Principal or Agent and not mentioned in the document).
  4. Notarization (Mandatory): For property transactions, a Notary Public must witness the Principal's signature. This is required for the document to be "recordable" at the County Recorder or Registrar of Deeds.
  5. Digital Signature (Caution): While DocuSign is widely accepted for contracts, land registries often require "wet ink" signatures for Powers of Attorney. Check with your local title company or land registry before using digital signatures.
  6. Recording: Take the original, notarized document to the County Recorder’s Office or Bureau of Conveyances where the property is located. Filing the document provides "constructive notice" to the public of the Agent's authority.
  7. Retention: Store the original in a secure location. Provide certified copies to the Agent and any financial institutions or title companies involved in the transaction.
