2. OPERATIVE CLAUSES
1. Rent and Payment
1.1 The Tenant agrees to pay the Rent to the Lessor or the Lessor’s Agent in advance, without demand, at the intervals and via the payment method specified in Item 1.6. 1.2 The Lessor/Agent shall provide a receipt for any rent paid in cash or by cheque, or where payment is made otherwise, within the statutory timeframe mandated by the Act.
2. Rental Bond
2.1 The Tenant shall pay the Rental Bond specified in Item 1.6 to the Lessor or Lessor’s Agent on or before the signing of this Agreement. 2.2 The Lessor/Agent shall remit the Rental Bond to the Residential Tenancies Authority (RTA) within the statutory period required by the Act (10 days). 2.3 The Bond is held by the RTA as security for the performance of the Tenant’s obligations under this Agreement and shall be dealt with in accordance with the Act upon termination.
3. Outgoings and Utilities
3.1 The Tenant is responsible for the connection and ongoing cost of all utility services supplied to the Premises that are separately metered, including electricity, gas, internet, and telephone, unless otherwise specified herein. 3.2 In accordance with Section 165 of the Act, the Tenant shall pay for water consumption charges, provided the Premises are individually metered, water efficient devices are installed, and the property meets all statutory efficiency standards.
4. Maintenance, Repairs, and Condition
4.1 The Tenant acknowledges receipt of the Entry Condition Report (Form 1a) and agrees to complete, sign, and return the same to the Lessor/Agent within 3 business days of taking possession. 4.2 The Tenant must maintain the Premises in a clean, tenantable condition, fair wear and tear excepted, and immediately notify the Lessor/Agent of any structural damage, water ingress, or required urgent repairs. 4.3 The Tenant shall not make alterations, additions, or affix fixtures to the Premises without the prior written consent of the Lessor.
5. Quiet Enjoyment and Inspection
5.1 The Lessor permits the Tenant quiet enjoyment of the Premises during the Term, subject to the Lessor’s statutory rights of entry. 5.2 The Lessor or Lessor’s Agent may enter the Premises for routine inspections, maintenance, or showing the property to prospective buyers/tenants, strictly in compliance with the mandatory notice periods and frequency limits prescribed by the Act.
6. Rules, Regulations, and Body Corporate
6.1 The Tenant, occupants, and invitees shall comply with all local laws, council regulations, and—where the Premises is a unit, townhouse, or apartment—the applicable Body Corporate By-Laws. 6.2 A copy of the current Body Corporate By-Laws has been provided to the Tenant prior to entering into this Agreement.
7. Pets
7.1 Pets are [Permitted / Not Permitted] on the Premises.
7.2 If permitted, the keeping of any animal is subject to the conditions outlined in the pet approval addendum attached hereto and the provisions of the Act regarding pet requests.
8. Breach, Termination, and Abandonment
8.1 If either party breaches a material term of this Agreement, the aggrieved party may issue a Notice to Remedy Breach (Form 11) allowing the statutory remedy period to rectify the default. 8.2 Termination of this Agreement by either party must be executed in strict accordance with the notice periods and statutory forms mandated under Chapter 3 of the Act. 8.3 Abandonment of the Premises shall be handled in accordance with the statutory abandonment provisions of the Act.
9. Dispute Resolution
9.1 In the event of any dispute arising out of this tenancy, the parties agree to utilize the dispute resolution services of the RTA prior to initiating formal proceedings in the Queensland Civil and Administrative Tribunal (QCAT).
