4. OPERATIVE CLAUSES & TERMS
Clause 1: Standard Terms
The standard terms and conditions set out in the Residential Tenancies and Rooming Accommodation Act 2008 (QLD) apply to this agreement. In the event of any inconsistency between this agreement and the Act, the Act shall prevail to the extent of the inconsistency.
Clause 2: Condition Report
The Lessor or Property Manager must provide the Tenant with a signed Entry Condition Report (Form 1a) on or before the Commencement Date. The Tenant must complete, sign, and return the Entry Condition Report to the Lessor/Agent within 7 days of taking occupation, noting any discrepancies.
Clause 3: Use of Premises
The Tenant shall use the Premises exclusively as a private residential dwelling. The Tenant shall not assign, sub-let, or transfer possession of the premises or any part thereof without the prior written consent of the Lessor, which consent shall not be unreasonably withheld subject to the provisions of the Act.
Clause 4: Maintenance, Repairs & Alterations
- The Tenant must keep the Premises in a clean, tenantable state and notify the Lessor/Agent promptly of any structural damage or required maintenance.
- The Tenant shall not make any alterations, additions, or affix fixtures to the Premises without obtaining the prior written consent of the Lessor.
