REMOTE WORK & TELECOMMUTING POLICY AGREEMENT

Document ID: RWA-SHRM-2026-V1
Effective Date: [Effective Date]
Version: 1.0 (Institutional Baseline)
Governing Jurisdiction: [State / Province, Country]

1. STATUTORY & LEGAL COMPLIANCE NOTICE

Clinical Disclaimer: This Remote Work Agreement Template is structured in alignment with Society for Human Resource Management (SHRM) compliance standards, federal labor guidelines, and state-level statutory frameworks. However, remote work arrangements introduce multi-jurisdictional compliance complexities, including wage-and-hour tracking, state tax nexus generation, workers' compensation liabilities, and mandatory statutory expense reimbursements. Execution of this document must be preceded by localized legal review to ensure compliance with the specific municipal, state, and federal laws governing the employee's physical worksite.

2. PARTIES & RECITALS

This Remote Work & Telecommuting Policy Agreement (the "Agreement") is entered into as of [Effective Date] (the "Effective Date"), by and between:

Employer: [Company Full Legal Name], a [State of Incorporation] [Corporation / LLC] having its principal place of business at [Principal Address] (hereinafter referred to as the "Company"), and

Employee: [Employee Full Legal Name], residing at [Employee Primary Residential Address] (hereinafter referred to as the "Employee").

RECITALS

WHEREAS, the Company desires to permit the Employee to perform their job duties from an alternative designated worksite;
WHEREAS, the Employee desires to engage in remote work subject to the terms, conditions, operational requirements, and policies set forth herein; and
WHEREAS, both parties acknowledge that remote work is a work arrangement and not a change in the fundamental employment-at-will relationship, job description, or compensation structure;

NOW, THEREFORE, in consideration of the mutual covenants, promises, and conditions contained herein, the parties agree as follows:

3. EXHAUSTIVE OPERATIVE CLAUSES & LEGAL TERMS

Section 1: Scope of Remote Work & Designated Worksite

1.1 Designated Worksite. The Employee is authorized to perform assigned job duties exclusively from the following approved telecommuting location (the "Designated Worksite"): [Complete Street Address, Apt/Suite, City, State, Zip Code].

1.2 Worksite Modification. The Employee shall not change the Designated Worksite without providing at least thirty (30) calendar days prior written notice to the Company and obtaining explicit written authorization from Human Resources and Legal Counsel. The Company reserves the right to deny requests to relocate based on tax nexus, operational, and regulatory compliance risks.

1.3 Home Office Suitability. The Employee represents and warrants that the Designated Worksite is safe, secure, free from recognized physical hazards, and equipped with a dedicated workspace that ensures privacy for handling confidential Company data, proprietary information, and uninterrupted telephonic or video communication during core working hours.

Section 2: Compensation, Working Hours, & Timekeeping

2.1 Compensation & Benefits. The Employee's base salary, wage rate, employee benefits, and opportunities for compensation adjustments shall remain unchanged by this Agreement, except as may be explicitly modified by separate written instrument or statutory requirement.

2.2 Working Hours & Availability. The Employee agrees to maintain core working hours of [Start Time] to [End Time], [Time Zone], Monday through Friday, or as otherwise designated by their supervising manager. The Employee must be accessible via telephone, email, messaging platforms, and video conferencing software during these core hours.

2.3 Non-Exempt Employees (Time Tracking). If the Employee is classified as non-exempt under the Fair Labor Standards Act (FLSA) and applicable state wage-and-hour laws: (a) The Employee must accurately record all hours worked using the Company’s official electronic timekeeping system: [Name of Timekeeping System]. (b) Unauthorized, unapproved, or off-the-clock overtime is strictly prohibited. Any overtime work must be authorized in advance and in writing by the Employee's direct supervisor. (c) Mandatory rest and meal breaks must be taken in strict compliance with state and federal statutory requirements.

Section 3: Equipment, Technology, & Expense Reimbursement

3.1 Company-Provided Equipment. The Company may provide specific hardware, software, and peripheral equipment (collectively, the "Company Equipment") necessary for the performance of the Employee's duties. The Company Equipment remains the exclusive property of the Company at all times.

3.2 Acceptable Use & Security. Company Equipment shall be used exclusively for authorized Company business by the Employee. The Employee shall not permit family members, third parties, or unauthorized individuals to access or utilize Company Equipment. The Employee shall implement mandatory security protocols, including encrypted hard drives, password protection, virtual private network (VPN) access, and immediate installation of system updates.

3.3 Expense Reimbursement. The Company shall reimburse the Employee for reasonable, necessary, and pre-approved out-of-pocket business expenses directly incurred in the execution of their duties, strictly in accordance with the Company’s Expense Reimbursement Policy. Claims must be submitted via [Expense System Name] within thirty (30) days of incurrence, accompanied by itemized receipts.

3.4 Personal Utilities & Internet. Unless mandated by applicable state law (e.g., California Labor Code Section 2802), the Employee is responsible for maintaining a reliable, high-speed broadband internet connection ([Minimum Download Speed / Upload Speed requirement]) and adequate workspace utilities at their own expense.

Section 4: Term & Termination of Remote Arrangement

4.1 At-Will Employment Unaffected. Nothing in this Agreement alters the "at-will" nature of the employment relationship between the Company and the Employee. Either party may terminate the employment relationship at any time, with or without cause, and with or without notice, subject to applicable law.

4.2 Termination of Remote Work Arrangement. The Company reserves the absolute right to revoke this remote work authorization and require the Employee to return to a physical Company office facility at any time, with or without cause, upon providing a minimum of [e.g., Fourteen (14)] calendar days written notice to the Employee.

4.3 Return of Company Property. Upon termination of this Agreement, termination of employment, or upon demand by the Company, the Employee shall immediately return all Company Equipment, documents, data, access tokens, and physical property to the Company’s designated corporate office in working order, ordinary wear and tear excepted, within [e.g., Forty-Eight (48)] hours.

Section 5: Intellectual Property Ownership & Work Made for Hire

5.1 Work Made for Hire. All work product, inventions, designs, code, documents, reports, data, and intellectual property created, conceived, or developed by the Employee in the course of performing remote work (collectively, "Work Product") shall be deemed a "work made for hire" under the copyright laws of the United States.

5.2 Assignment. To the extent that any Work Product does not qualify as a work made for hire, the Employee hereby irrevocably assigns, transfers, and conveys to the Company all right, title, and interest worldwide in and to such Work Product, including all intellectual property rights therein.

Section 6: Mutual Confidentiality & Information Security

6.1 Confidential Information. The Employee acknowledges that during the course of remote work, they will have access to confidential, proprietary, and trade secret information of the Company, including customer lists, financial data, source code, business strategies, and personnel files ("Confidential Information").

6.2 Non-Disclosure Obligations. The Employee agrees to maintain strict confidentiality regarding all Confidential Information and to implement rigorous physical and digital safeguards at the Designated Worksite to prevent unauthorized access, viewing, duplication, or removal. This includes utilizing privacy screens, locking physical doors when the workspace is unattended, and securing paper documents in locked storage containers.

Section 7: Health, Safety, & Workers' Compensation

7.1 Safe Work Environment. The Employee is responsible for maintaining a safe physical work environment at the Designated Worksite. The Employee agrees to report any work-related injury, illness, or safety hazard to the Company’s Human Resources Department within twenty-four (24) hours of occurrence.

7.2 Workers' Compensation Coverage. Workers' compensation insurance coverage extends strictly to injuries arising out of and in the course of employment. Such coverage is limited to the designated workspace within the Designated Worksite during authorized working hours and does not extend to injuries sustained outside the scope of employment or in unapproved areas.

Section 8: Representations, Warranties, & Compliance

8.1 Tax & Regulatory Compliance. The Employee acknowledges sole responsibility for any personal tax implications, municipal licensing requirements, or zoning laws associated with maintaining a home office in the Designated Worksite jurisdiction. The Employee agrees to notify the Company immediately of any change in primary residence or tax jurisdiction.

Section 9: Dispute Resolution & Governing Law

9.1 Governing Law. This Agreement shall be interpreted, construed, and enforced in accordance with the laws of the State of [State / Province], without regard to its conflict of laws principles.

9.2 Mandatory Arbitration. Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach thereof, shall be settled by binding arbitration administered by the [American Arbitration Association / JAMS] in accordance with its Employment Arbitration Rules, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Section 10: Miscellaneous Provisions

10.1 Severability. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
