4. STEP-BY-STEP EXECUTION & FILING GUIDE

STEP 1: DATA ENTRY

  • Open this document in Microsoft Word or Google Docs.
  • Replace all bracketed text (e.g., [Borrower Full Legal Name]) with the actual data. Ensure addresses are current and legal names match government-issued identification.

STEP 2: INTEREST RATE VERIFICATION

  • Consult the IRS website for the current "Applicable Federal Rate" (AFR). Setting an interest rate below this level for family loans over $10,000 may result in the IRS treating the interest "foregone" as a taxable gift.

STEP 3: SIGNATORY AUTHORITY & WITNESSING

  • For intra-family loans, it is highly recommended to have the signature witnessed by a Notary Public. This prevents the Borrower from later claiming the document is a forgery or was signed under duress.

STEP 4: DIGITAL EXECUTION (IF APPLICABLE)

  • If using DocuSign or Adobe Sign, upload the completed PDF.
  • Ensure "Audit Trail" features are enabled to track IP addresses and timestamps of the signatures.

STEP 5: DISBURSEMENT AND DOCUMENT RETENTION

  • Lender: Do not provide cash. Provide a paper trail (Wire or Check) and keep a copy of the receipt.
  • Storage: Store the original signed Note in a fireproof safe or secure digital vault. The Lender must retain the original "Wet Ink" copy to satisfy "Holder in Due Course" requirements in many jurisdictions if a lawsuit is required.

STEP 6: REPAYMENT TRACKING

  • Maintain a "Ledger of Payments" attached to this Note to record every payment made, the date, and the remaining balance. Both parties should initial this ledger periodically.
