4. STEP-BY-STEP EXECUTION & FILING GUIDE
STEP 1: DATA ENTRY
Open the document in a word processor (Microsoft Word or Google Docs). Use the Find and Replace function or manually navigate to all bracketed fields (e.g., [Amount in USD]). Ensure that the "Effective Date" matches the date the first service was rendered or the date of signing.
STEP 2: VERIFICATION OF AUTHORITY The Lender must verify that the Borrower has the legal right to sign for the Deceased (e.g., as the named Executor in a Will, or as the legal Next of Kin under state statutes). Request a copy of the Borrower's government-issued ID to verify the "Printed Name" and "Principal Address."
STEP 3: DIGITAL OR PHYSICAL EXECUTION
- If Digital: Upload the finalized document to DocuSign, Adobe Sign, or PandaDoc. Ensure "Audit Trail" features are enabled to track IP addresses and timestamps of signatures.
- If Physical: Print two (2) copies. Both parties should sign both copies. Wet-ink signatures are preferred in some jurisdictions for promissory notes.
STEP 4: NOTARIZATION (OPTIONAL BUT RECOMMENDED) While not strictly required for all promissory notes, having the Borrower's signature notarized significantly reduces the likelihood of "fraudulent signature" defenses in the event of collection litigation.
STEP 5: RECORD RETENTION The Lender must store the original signed Note in a secure, fireproof location. A digital scan should be uploaded to the Lender’s Practice Management System or CRM. Provide a full copy (digital or physical) to the Borrower immediately following execution.
STEP 6: DISCHARGE Upon the final payment reaching $0.00 balance, the Lender should issue a "Release of Promissory Note" or mark the original Note as "PAID IN FULL" and return a copy to the Borrower to conclude the legal obligation.
