FOR [DEBTOR NAME]: Signature: _____________________________________ Printed Name: [Patient/Guardian Legal Name] Title: [Patient / Representative] Date: [Date]
5. STEP-BY-STEP EXECUTION AND FILING GUIDE
- Drafting: Replace all bracketed
[...]text with the specific, verified details of the hospital and patient. Verify that the signatory has the legal capacity to contract (i.e., not a minor, possesses mental capacity).
- Execution: Use blue or black ink. If executing digitally, ensure the use of an e-signature platform compliant with the Philippine E-Commerce Act (RA 8792), such as DocuSign or Adobe Sign, which provides an audit trail.
- Notarization: While not strictly required for a private document to be valid, it is highly recommended to have this document notarized. This converts the document into a "Public Document," which carries greater evidentiary weight in court proceedings.
- Retention: The original signed document must be stored in the Hospital’s Finance/Billing Department in a fireproof/secure environment for a minimum of ten (10) years, or as mandated by the Bureau of Internal Revenue (BIR) for accounting records.
- Data Privacy Compliance: Provide the Patient with the Hospital’s Privacy Notice/Consent form simultaneously to ensure full compliance with the National Privacy Commission (NPC) requirements.
