5. STEP-BY-STEP EXECUTION & FILING GUIDE
Step 1: Document Preparation & Review
- Open the document template in Microsoft Word, Google Docs, or an authorized contract management system.
- Replace all bracketed placeholder text (e.g.,
[Institution Full Legal Name],[Amount in USD],[Interest Rate]) with verified factual data. Ensure numerical values match written spelled-out equivalents where applicable. - Legal and Financial Review: Verify that the designated interest rate complies with state usury caps and applicable education finance regulations (such as TILA disclosures if deemed a consumer credit transaction).
Step 2: Verification of Signatory Authority
- Institutional Signatory: Verify that the individual signing on behalf of the educational institution holds the appropriate corporate, board, or administrative authority (e.g., Bursar, CFO, Dean) to bind the institution to financial agreements.
- Borrower & Guarantor Verification: Confirm the legal identity of the student borrower and, where required, the creditworthiness and identity of the co-signer/guarantor via government-issued photo identification.
Step 3: Digital or Wet-Ink Execution
- Digital Execution (Recommended): Upload the finalized document into an institutional-grade electronic signature platform (e.g., DocuSign, Adobe Sign) with audit trailing enabled. Route the document sequentially: first to the Student Borrower, second to the Co-Signer (if applicable), and finally to the Institutional Authorized Signatory.
- Wet-Ink Execution: If executed in physical form, ensure all parties sign in blue ink in the presence of a notary public if required by local state jurisdiction for enforceability of educational notes.
Step 4: Record Retention & Archiving
- Secure Vault Storage: Upon complete execution, generate the Certificate of Completion / Audit Trail (if signed digitally) and combine it with the final executed PDF into a single unified record.
- Institutional Ledger Entry: Input the principal amount, amortization schedule, and repayment milestones into the institution's accounts receivable and student financial ledger systems.
- Retention Period: Store the executed Note securely in the institution’s financial archives or digital document management system for a minimum of seven (7) years following full repayment and satisfaction of the debt, or in accordance with institutional record retention policies and applicable statute of limitations laws.
