4. Step-by-Step Operational Procedure

Phase I: Drafting and Validation

• Verify the specific "Special" nature of the PoA (must explicitly name the property address, survey number, and nature of transaction).
• Confirm the Principal’s mental competence and intent; record metadata of signing session if remote.
• Audit the draft against state-specific stamp duty schedules to prevent future rejection during registration.

Phase II: Execution and Notarization

• Principal signs the document in the presence of two witnesses.
• Ensure the Notary Public affixes the seal and registration number on every page.
• If the Principal is an NRI, complete the document at the nearest Indian Embassy or Consulate; initiate the Apostille process if applicable.

Phase III: Registration (Compulsory in most Indian States)

6. Practical Troubleshooting Scenarios

• Corrective Action: Immediate cessation of processing. Pay the deficit amount via the state’s digital treasury portal or demand draft. Obtain a "Penalty Payment Receipt" and re-submit the instrument. Do not attempt to use white-out or manual alterations.

Scenario B: Principal becomes incapacitated or passes away post-execution but pre-registration.

• Corrective Action: In India, a Power of Attorney terminates upon the death of the Principal. If death occurs, the Agent loses all authority.
