5. STEP-BY-STEP EXECUTION & FILING GUIDE
- Document Customization: Open this document in Microsoft Word, Google Docs, or a compatible text editor. Replace all bracketed text prompts (e.g.,
[Principal Full Legal Name],[Effective Date]) with the precise legal details of the parties involved. Remove all instructional brackets and formatting hints prior to execution. - Verify Legal Capacity & Intent: Ensure the Principal possesses full legal capacity, is acting under no duress or undue influence, and fully understands the broad scope of financial and administrative control conferred upon the Agent.
- Signatory Verification: Verify the identity of the Principal and the designated Agent using government-issued photo identification prior to execution.
- Formal Execution & Notarization: This instrument should be executed in the physical presence of a licensed Notary Public of the State of Wisconsin. The Principal must sign the document before the Notary, who will complete the jurat/acknowledgment block. While Wisconsin law does not universally mandate notarization for all powers of attorney, financial institutions and title companies routinely require notarized signatures to honor third-party agency instruments.
- Agent Acknowledgment: The Agent must sign the "Acceptance of Appointment" section to formally manifest consent to the fiduciary obligations established herein.
- Digital Execution (Optional): If executing remotely via digital signature platforms (such as DocuSign or Adobe Sign), ensure the platform complies with the Wisconsin Uniform Electronic Transactions Act (Wis. Stat. Ch. 137) and incorporates robust identity verification and tamper-evident audit trails. Note that remote online notarization (RON) must comply strictly with Wisconsin statutory requirements if utilized.
- Record Retention: Provide the original executed document (or a certified true copy) to the Agent. Retain the master original in a secure, accessible location (such as a fireproof safe or secure institutional vault). Provide copies to relevant financial institutions, legal counsel, and successor agents only as required for the administration of the Principal's affairs.
