7. STEP-BY-STEP EXECUTION & FILING GUIDE

Step 1: Preparation of the Document

  • Open this document in a word processor (Microsoft Word or Google Docs).
  • Use the "Find and Replace" function to locate all bracketed fields (e.g., [Principal Full Legal Name]).
  • Ensure all names match legal identification (Driver's License or Passport).

Step 2: Selecting Witnesses

  • Identify two witnesses. Crucial: They must NOT be the Attorney, their spouse, your spouse, your child, or anyone under 18.
  • Ensure both witnesses are physically present in the same room as you when you sign.

Step 3: Formal Execution

  • Physical Signing: Print the document. The Principal must sign first in the designated block.
  • Witness Signing: Immediately after the Principal signs, Witness 1 and Witness 2 must sign and provide their addresses.
  • Digital Signing (Caution): While Ontario allows for virtual witnessing under specific conditions (Section 3.1 of the SDA), it requires at least one witness to be a licensee of the Law Society of Ontario (Lawyer or Paralegal). For standard DIY execution, physical "wet-ink" signatures are recommended for maximum enforceability with financial institutions.

Step 4: Verification & Capacity

  • If there is any doubt regarding the Principal's mental capacity, obtain a "Capacity Assessment" from a qualified professional at the time of signing to prevent future litigation.

Step 5: Distribution & Record Retention

  • Originals: Keep the original document in a fireproof safe or with your lawyer.
  • Certified Copies: Provide certified true copies to your Attorneys, your primary bank (e.g., RBC, TD, Scotiabank), and your primary care physician.
  • Notification: Inform your family members that this document exists to prevent conflicting applications for guardianship.
