4. STEP-BY-STEP EXECUTION & FILING GUIDE
- Drafting and Customization: Open this document in Microsoft Word or Google Docs. Replace all bracketed text (e.g.,
[Company Full Legal Name]) with the specific legal details of the parties. Ensure the "Effective Date" matches the date of the final signature. - Verify Signatory Authority: For the Principal, ensure the person signing is a corporate officer (CEO, President, Secretary) or an authorized member/manager if the entity is an LLC. For the Attorney, ensure the signer is a licensed practitioner.
- Digital Execution:
- Upload the finalized document to an e-signature platform (DocuSign, Adobe Sign, or PandaDoc).
- Assign signature tags to the respective blocks.
- Ensure the platform generates a "Certificate of Completion" to prove the digital audit trail.
- Notarization (If Required): While the USPTO generally does not require notarized PoAs, many international jurisdictions (e.g., China, Middle Eastern countries) require the PoA to be notarized and/or Apostilled. Verify with the local counsel in the target jurisdiction.
- Filing with Registry:
- Save the executed document as a high-resolution PDF/A.
- In the USPTO TEAS system, upload the PDF under the "Power of Attorney" section of the application or as a standalone "Request for Withdrawal of Attorney/Appointment of Attorney" if an application is already pending.
- Record Retention: Maintain the original signed copy (or the digital original with audit log) in the Principal’s corporate minute book and the Attorney’s client file for a period of no less than seven (7) years following the expiration of the Mark's registration.
