IV. STEP-BY-STEP EXECUTION & FILING GUIDE

To ensure this Power of Attorney is legally binding and functional for a Rent Agreement, follow these steps:

  1. Customization: Open this document in Microsoft Word or Google Docs. Replace all bracketed text (e.g., [Principal Full Legal Name]) with the actual legal information. Ensure the Property description matches the Title Deed exactly.
  2. Verification of Authority: If the Principal is a Company, ensure the signatory has a Board Resolution authorizing the issuance of this POA.
  3. Witnessing: Most jurisdictions require at least two (2) witnesses who are not related to the Principal or the Attorney-in-Fact.
  4. Notarization: Take the unsigned document to a Notary Public. The Principal must sign in the presence of the Notary.
  5. Registration/Apostille:
    • If the Property is in a different country, you may need an Apostille or Consular legalization.
    • If the local law requires "Mandatory Registration" for POAs involving real estate (common in jurisdictions like India or UAE), the document must be registered at the Sub-Registrar's office.
  6. Digital Signature (Optional): If using DocuSign or Adobe Sign, ensure the "Certificate of Completion" is attached to the final document. Note: Many Land Registries do not yet accept digital signatures for property-related POAs; check local regulations first.
  7. Record Retention: The Attorney-in-Fact should keep the original. The Principal should keep a certified copy. Provide a copy to the Bank and the Tenant during the Rent Agreement execution.
