V. NOTARY ACKNOWLEDGMENT (MANDATORY FOR LAND SALE)

STATE/PROVINCE OF ___________________ COUNTY OF ___________________________

On this ______ day of ___________, 20, before me, the undersigned Notary Public, personally appeared [Principal Full Legal Name], known to me (or satisfactorily proven) to be the person whose name is subscribed to the within instrument and acknowledged that he/she executed the same for the purposes therein contained.

WITNESS my hand and official seal.

_____________________________________ (Signature of Notary) My Commission Expires: [Date] [Notary Seal Must Be Affixed Here]

VI. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Preparation of Exhibit A: Ensure a full legal description of the property (Metes and Bounds or Lot/Block/Subdivision) is attached as "Exhibit A." A simple street address is often insufficient for title companies.
  2. Bracketed Information: Complete all fields marked in [Blue Brackets]. Use the "Find and Replace" function in your word processor to ensure consistency.
  3. Witnesses: Most jurisdictions require two disinterested witnesses in addition to a Notary Public for real estate documents. Ensure witnesses are present during signing.
  4. Notarization: This document must be notarized. The Agent should not sign until they are in the presence of the Notary, or as dictated by local law.
  5. Digital Signature Caution: While DocuSign is widely accepted for contracts, County Recorders and Registers of Deeds often require "Wet Signatures" for POAs related to land transfer. Verify with the title company or local recorder before using electronic signatures.
  6. Recordation: This Power of Attorney should be recorded in the Land Records office of the county where the property is located, typically simultaneously with the Deed of Sale.
  7. Retention: Maintain the original wet-ink document in a secure location. Provide certified copies to the Title Company, Closing Attorney, and the Agent's financial institution.
