5. STEP-BY-STEP EXECUTION & FILING GUIDE

Step 1: Document Customization

Open this document in Microsoft Word or Google Docs. Populate all fields contained within brackets [...]. Ensure the "Effective Date" matches the date of the final signature.

Step 2: Verify Signatory Capacity

Ensure the Principal understands the nature and effect of the document. Under Queensland law, the Principal must have decision-making capacity at the time of signing.

Step 3: Formal Witnessing

In Queensland, a General Power of Attorney must be signed by the Principal in the presence of a witness. While a standard witness may suffice for some commercial uses, it is highly recommended that the witness be a Justice of the Peace (JP), Commissioner for Declarations, or a Lawyer, particularly if the document will be used for Land Title transactions.

Step 4: Digital Execution (DocuSign/Adobe Sign)

If executing via digital signature:

  • Ensure the platform provides a "Certificate of Completion" or "Audit Trail."
  • Warning: Queensland Titles Registry may require "wet-ink" signatures for documents involving the transfer of real property. If land dealings are expected, execute physical "wet-ink" copies.

Step 5: Registration (Optional but Recommended)

For the Attorney to deal with real estate in Queensland, this Power of Attorney must be registered with the Queensland Titles Registry (Form 16).

Step 6: Record Retention

  • The Attorney must keep an original executed copy.
  • The Principal must retain an original executed copy.
  • Certified copies should be provided to financial institutions (banks, brokers) as required.
