5. STEP-BY-STEP EXECUTION & FILING GUIDE
- Document Customization: Open this document in Microsoft Word or Google Docs. Replace all bracketed placeholder text (e.g.,
[Principal Full Legal Name],[Principal Address],[Effective Date]) with accurate, verified legal data. Do not leave any uncompleted brackets. - Scope Selection: Review Section 1 carefully. The Principal must explicitly initial the designated lettered lines representing the exact financial and legal powers conferred upon the Agent. Uninitialized sections are legally excluded.
- Principal Execution & Notarization: The Principal must sign this document in the physical presence of a New York State Notary Public. The Notary must complete the mandatory New York statutory acknowledgement block, including commission expiration and registration number.
- Agent Execution & Notarization: The designated Agent (and any Successor Agent) must execute the Agent Acknowledgment section in the presence of a Notary Public prior to conducting any transactions on behalf of the Principal.
- Digital Execution Limitations: While electronic signatures (e.g., DocuSign, Adobe Sign) are broadly utilized in commercial contexts, New York statutory Powers of Attorney require strict compliance with formal acknowledgment rules. Traditional wet-ink signatures executed before a physical Notary Public remain the gold standard to ensure immediate acceptance by New York financial institutions, title companies, and banks.
- Record Retention & Distribution:

- Provide certified true copies of the executed Power of Attorney to the Agent(s) and any relevant financial institutions (banks, brokerages, title agents) as required to operationalize the granted authorities.
