SECTION 7: STEP-BY-STEP EXECUTION & FILING GUIDE
- Document Customization:
Open this document in Microsoft Word or Google Docs. Replace all bracketed text fields (e.g.,
[Principal Full Legal Name],[Effective Date],[County]) with the precise legal details of the Principal and Agent. Ensure all dates match. - Review of Grant of Authority: Carefully review Section 3.1. Place initials in the "YES" or "NO" boxes for each specific financial and legal power. Un-initialed or unchecked boxes may prevent the Agent from executing necessary actions with third-party institutions (e.g., New York banks, title companies).
- Execution Requirements (New York Law Mandate): Under New York General Obligations Law § 5-1501B, this Power of Attorney must be signed by the Principal in the presence of a Notary Public. Furthermore, the Notary Public must witness the signature.
- Agent Acceptance & Notarization: The Agent must also sign the Agent Acknowledgment (Section 6.3) in the presence of a Notary Public before exercising any authority granted under this instrument.
- Digital Signature & Electronic Execution: If utilizing digital execution platforms (e.g., DocuSign or Adobe Sign), ensure that the platform complies with the Electronic Signatures and Records Act (ESRA) of New York. However, remote online notarization (RON) must strictly adhere to New York Executive Order / statutory provisions governing RON. Traditional wet-ink signatures followed by physical notarization are strongly recommended for banking and real estate transactions within New York City.
- Record Retention & Third-Party Presentation: The Principal must retain the original wet-ink signed document in a secure, accessible location (e.g., a fireproof safe or attorney's office). Provide certified copies to the Agent. When interacting with New York financial institutions, title companies, or healthcare providers, present the certified copy along with the Agent's valid government-issued identification.
