STEP-BY-STEP EXECUTION & FILING GUIDE
- Field Completion: Open the document in Microsoft Word or Google Docs. Use the
[Bracketed]fields to input the Principal's and Agent's full legal names (as they appear on government IDs), addresses, and the specific New Jersey county of residence. - Verification of Capacity: Ensure the Principal is of sound mind at the moment of signing. If capacity is questioned, obtain a brief letter from a licensed physician.
- Physical Execution (Recommended): While NJ allows for electronic signatures, traditional "wet ink" signatures are highly recommended for Power of Attorney forms to ensure acceptance by all banking institutions and the County Clerk for real estate transactions.
- Witnessing & Notarization:
- The Principal must sign in the presence of a Notary Public.
- Under New Jersey law, for the document to be used for real estate transactions, it must be acknowledged in the same manner as a deed (notarized).
- Digital Execution (Optional): If using DocuSign or Adobe Sign, ensure the platform provides a "Certificate of Completion" that includes IP addresses and timestamps. Note: Some NJ County Clerks may refuse digital signatures for land recording.
- Record Retention & Distribution:
- Original: The Agent should keep the original document in a fireproof safe.
- Certified Copies: Provide copies to the Principal’s bank, investment advisor, and primary care physician.
- Recording: If the Principal owns real estate, file a copy of this POA with the County Clerk in the county where the property is located to ensure the Agent can sell or mortgage the property if necessary.
