6. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Field Completion: Open this document in Microsoft Word or Google Docs. Use the [Find and Replace] function to locate all bracketed terms (e.g., [Principal Full Legal Name]) and replace them with accurate, legal data.
  2. Initialing Powers: The Principal must physically initial each lettered power (A through N) in Section 3.2. Striking through or leaving powers blank may result in a "Limited" Power of Attorney.
  3. Signatory Authority: Ensure the Principal is of sound mind at the moment of signing. If the Principal is signing on behalf of a corporate entity, ensure the "Title" field in the signature block accurately reflects their authority (e.g., "CEO", "Managing Member").
  4. Digital vs. Physical Execution: While NY GOL allows for electronic signatures, most financial institutions in Queens (e.g., Chase, TD Bank) frequently require "wet ink" signatures for real estate and banking transactions. It is highly recommended to execute this document in physical form.
  5. Notarization and Witnesses: Under NY law, the Principal's signature must be notarized. At least two witnesses (who are not the Agent) must sign. The Agent's signature must also be notarized for the document to be effective for banking.
  6. Record Retention:
    • Original: Keep in a fireproof safe or with legal counsel.
    • Recording: If used for real estate in Queens, the original must be recorded with the NYC Department of Finance (ACRIS) for Queens County.
    • Digital Copies: Upload a scanned PDF to a secure cloud environment (e.g., DocuSign or Ironclad) for immediate access.
