STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Preparation: Open this document in Microsoft Word or Google Docs. Use the Find and Replace function (Ctrl+H) to locate all bracketed text (e.g., [Principal Full Legal Name]) and input the specific details of your transaction.
  2. Exhibit A: Ensure you attach a detailed description of the property (Legal Description for Real Estate; VIN/Title Number for Vehicles) as Exhibit A.
  3. Signatory Verification: Verify that the person signing for the Attorney-in-Fact has the actual corporate authority to bind the entity (e.g., an Officer or Director).
  4. Notarization: This document must be signed in the presence of a Notary Public. Most county recorders and DMVs will reject a Power of Attorney for title transfer that is not notarized with a raised seal or stamp.
  5. Digital Execution: If using DocuSign or Adobe Sign, ensure the platform provides a "Digital Audit Trail" certificate. Note: Many jurisdictions still require "wet ink" signatures for land title recordings. Check local county clerk requirements before using digital signatures.
  6. Recording: Take the original notarized document to the relevant government office (County Recorder, Registrar of Deeds, or DMV) along with the new title/deed applications.
  7. Retention: Retain the original document in a secure fireproof safe. Provide a certified copy to the Attorney-in-Fact and any financial institutions involved in the closing.
