DURABLE POWER OF ATTORNEY FOR SOCIAL SECURITY AND GOVERNMENT BENEFITS
DOCUMENT ID: SSA-POA-2024-001
EFFECTIVE DATE: [Effective Date]
VERSION: 1.0.4
GOVERNING JURISDICTION: [State/Province], [Country]
1. STATUTORY & LEGAL COMPLIANCE NOTICE
NOTICE TO PRINCIPAL: This document is a Durable Power of Attorney. It grants your Attorney-in-Fact (Agent) broad powers to handle your affairs related to the Social Security Administration (SSA) and related government benefits. These powers will continue to exist even if you become disabled or incapacitated.
FEDERAL NOTICE: The Social Security Administration (SSA) generally does not recognize a standard Power of Attorney for the purpose of managing benefit payments. For the purpose of receiving and managing monthly benefit checks, the SSA utilizes a "Representative Payee" system. However, this document is intended to grant your Agent the authority to represent you in administrative proceedings, access records, and file applications. To fully satisfy SSA requirements for representation, the Principal and Agent should also execute Form SSA-1696 (Appointment of Representative) in conjunction with this document.
2. PARTIES & RECITALS
PRINCIPAL: This Durable Power of Attorney is executed by [Principal Full Legal Name], residing at [Principal Address] (hereinafter referred to as the "Principal").
ATTORNEY-IN-FACT: The Principal hereby appoints [Agent Full Legal Name], residing at [Agent Address] (hereinafter referred to as the "Agent"), to act as the Principal’s true and lawful attorney-in-fact.
RECITALS:
- WHEREAS, the Principal desires to delegate authority to the Agent regarding Social Security benefits, Medicare, and other federal/state entitlements.
- WHEREAS, the Principal intends for this delegation of authority to remain effective notwithstanding any subsequent disability or incapacity of the Principal.

- Witnessing & Notarization: Most jurisdictions require a Durable Power of Attorney to be notarized to be enforceable. Ensure the Principal signs in the presence of a Notary Public. Some states also require two disinterested witnesses.
- Digital Signature (DocuSign/Adobe Sign): If using digital signatures, ensure the platform provides a "Certificate of Completion" that includes IP addresses and timestamps to satisfy the SSA's evidence requirements if the document is uploaded digitally.
- SSA Form 1696: Immediately upon execution, the Agent should complete SSA Form 1696 (Appointment of Representative) and file it with the local Social Security field office to ensure the SSA recognizes the Agent's right to receive notifications.
- Record Retention: The original should be kept in a secure location (e.g., a fireproof safe). The Agent should be provided with a certified copy. Digital copies should be stored in an encrypted cloud environment.
- Filing: If the Principal owns real estate, some jurisdictions require the Power of Attorney to be recorded in the County Recorder’s Office to allow the Agent to handle property-related government liens.
