5. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Preparation: Open the document in Microsoft Word or Google Docs. Use the Find and Replace function (Ctrl+H) to replace all bracketed fields (e.g., [Principal Full Legal Name]) with your specific data.
  2. Legal Description: Ensure "Exhibit A" contains the "Legal Description" of the property (Metes and Bounds or Lot/Block), not just the street address. This is required by County Recorders.
  3. Witnessing: Many states (e.g., Florida, Georgia) require two witnesses in addition to a Notary Public for real estate documents. Check your local state code.
  4. Notarization: The Principal must sign in the presence of a licensed Notary Public. The Agent should also sign the "Acceptance of Appointment" section, though notarization of the Agent’s signature is secondary to the Principal's.
  5. Digital Signature: If using DocuSign or Adobe Sign, ensure the platform provides a "Digital Audit Trail" and check if your local County Recorder accepts electronic signatures for land records (many now do, but some rural counties require "wet" signatures).
  6. Recordation: For real estate transactions, the original notarized POA must be recorded in the County Recorder’s Office (or Registry of Deeds) where the property is located.
  7. Retention: Store the original recorded document in a fireproof safe. Provide certified copies to the Title Company, Closing Attorney, and Lending Institution involved in the transaction.
